Can it be anticipated
that one of the other five lanes of railroad tracks can be used for train diversion so that work
may be paused but not removed from the tracks? In addition, what is the railroad closure
duration?
Answer — The railroad impact times shown on Drawings S0.03 through S0.05 represent the
times provided to the BNSF Railway Company during the BNSF review process. These sheets
are now revised per this addendum to reflect consistency with the contract provisions.
The contractor must plan, schedule, coordinate and conduct all work so as to not cause any
delays to trains per the final agreement between BNSF and the Contractor (Exhibit "C-1").
Appendix page G1-56 (Volume 2 of 2) of the Contract Provisions, provides clear means for the
Contractor and BNSF to establish acceptable windows of operation based on real and actual
time frames which are to be inlcuded in the Schedule sumbitted to BNSF for review:
"Railway and Contractor will establish mutually agreeable work windows for the project.
Railway has the right at any time to revise or change the work windows due to train operations
or service obligations. Railway will not be responsible for any additional costs or expenses
resulting from a change in work windows. Additional costs or expenses resulting from a change
in work windows shall be accounted for in Contractor's expenses for the project."
Once provided a real time schedule the Railway can more accurately evaluate the availability of
the windows which mutually accommodate the need of BNSF to maintain uninterrupted service
and the Contractor to construct the bridge. It was anticipated during design that there will be a
range of times available, however, the designer and the City cannot set these times, and BNSF
will not establish these times until such time as a construction schedule and means and
methods for construction is submitted for review per the requirements of the Contract Bid
Documents and the agreement between BNSF and the Contractor.
City of Everett Addendum No. 7
Project Bid
Grand Avenue Park Bridge Page 2
Page 2
Provided to Builders Exchange of WA, Inc.
