. � <br /> However, the City may approve an alternative proposed by the Applicant fhat meets <br /> the goals, objectives and policies in this SMP. Adopted public access plans include, <br /> but are not limited to, An Urban Design Plan for Everett Harborfront, Everett <br /> Harborfront Public Access Plan, Everett Central City Development Plan, a <br /> Pedestrian and Bicycle Access Plan for Everett's Snohomish Riverfront, the Non- <br /> Motorized Transportation (Trail) Plan, or as such shall be superceded or amended. <br /> 11. Public access sites shall be connected directly to the nearest public street or trail. <br /> Findings: The adopted shoreline public access plan includes a path around the <br /> entire lake. There is an existing sidewalk abutting Green Lantern Park, which <br /> implements the plan along this part of the lake. The park itself is not specifically <br /> targeted by the plan for trail access. However, the proposed park improvements will <br /> augment the shoreline trail network by providing improved access to the waters' <br /> edge. <br /> 13. Public access improvements shall include provisions for persons with disabilities, <br /> where reasonably feasible. <br /> Findings: Existing access is provided via a non-accessible uneven footpath. The <br /> project is designed to improve accessibility to the park with a wider, level crushed <br /> gravel path. <br /> 17. Public access improvements shall be designed to minimize impacts to <br /> environmentally sensitive areas, ecological functions, or ecosystem-wide processes. <br /> A biological assessment (Planning Director's Interpretation), and potentially a habitat <br /> management plan (EMC 19.37 —Environmentally Sensitive Areas), shall be required <br /> for each project in shoreline jurisdiction. The City may require that buffers be <br /> increased based upon the results of that assessment. Mitigation of impacts shall be <br /> required as appropriate. <br /> Findings: Due to existing barriers that keep sensitive species from reaching the <br /> lake, development on Silver Lake is typically exempt from providing a biological <br /> assessment. Nontheless, because this project requires U.S. Army Corps of <br /> Engineers approval, a Biological Evaluation for informal consultation was prepared <br /> for the Corps. No adverse effects were identified. <br /> 3.9 Conservation Element <br /> 1. Except for within the Marshland Subarea, all development activities shall comply wi�h <br /> the City's Environmentally Sensitive Area Ordinance, EMC 19.33D.360-590, in effect <br /> on March 21, 2001, and Planning Director Interpretation No. Z-20Q0, Interim <br /> Procedures, Endangered Species Act Listing for Chinook Salmon and Bull Trout, <br /> unless more stringent requirements are adopted by City Council subsequent to that <br /> date. <br /> 3. Best available science shall be used in identifying, evaluating and mitigating impacts <br /> of development proposals. The City shall require sufficient geological, hydrological <br /> and biological studies to determine the impacts of the proposal. {See EMC 19.37 <br /> and Planning Direcfor Interpretation No. 2-2000 in Appendix A.) <br /> � <br /> Z,f '�; � <br />
