I <br /> CITY OF EVERETT SPECIAL PROVISIONS <br /> I <br /> working days: (1) charged to the Contract the week before; (2) specified for the <br /> physical completion of the Contract; and (3) remaining for the physical completion <br /> of the Contract. The statement will also show the nonworking days and partial or <br /> whole day the Engineer declares as unworkable. Within 14 calendar days after <br /> the date of each statement, the Contractor shall file a written protest of any <br /> alleged discrepancies in it. To be considered by the Engineer, the protest shall be <br /> in sufficient detail to enable the Engineer to ascertain the basis and amount of <br /> ' time disputed. By not filing such detailed protest in that period, the Contractor <br /> shall be deemed as having accepted the statement as correct. If the Contractor <br /> elects to work ten hours a day and four days a week (a 4-10 schedule) and the <br /> fifth day of the week in which a 4-10 shift is worked would ordinarily be charged as <br /> a working day then the fifth day of that week will be charged as a working day <br /> whether or not the Contractor works on that day. <br /> The Engineer will give the Contractor written notice of the Physical Completion <br /> Date for all Work the Contract requires. That date shall constitute the Physical <br /> Completion Date of the Contract, but shall not imply the City's acceptance of the <br /> Work or the Contract. <br /> The Engineer will give the Contractor written notice of the Completion Date of the <br /> Contract after all the Contractor's obligations under the Contract have been <br /> performed by the Contractor. The following events must occur before the <br /> Completion Date can be established: <br /> 1. The physical Work on the project must be complete; and <br /> 2. The Contractor shall furnish all documentation required by the Contract <br /> and required by law, to allow the City to process final acceptance of the <br /> Contract. <br /> The following documents must be received by the Engineer prior to establishing a <br /> Completion Date: <br /> a. Certified payrolls. <br /> b. Material Acceptance Certification Documents. <br /> c. Annual Report of Amounts Paid as MBE/WBE Participants. <br /> d. Final Contractor Voucher Certification. <br /> ' e. Copies of the approved "Affidavit of Prevailing Wages Paid" for the Contractor <br /> and all Subcontractors. <br /> ' Supplement 1-08.5 by adding the following: <br /> 1-08.5(2) Substantial Completion <br /> (******) <br /> When the Contractor considers the Work to be Substantially Complete and ready for <br /> its intended use, it shall give Notice to the City's Representative. The Notice shall <br /> include an itemized list of remaining incomplete Work. If the City's Representative <br /> determines the Work is not substantially complete, it will so notify the Contractor in <br /> writing, identifying the reasons for such a determination. If the City's Representative <br /> finds the Work substantially complete, it will meet with the Contractor to (1) prepare a <br /> Punch List of incomplete items of Work; (2) define the division of responsibility <br /> between City and Contractor with respect to security, operation, maintenance, heat, <br /> utilities, insurance, and warranties; and (3) describe other issues related to acceptance <br /> of the substantially completed Work. <br /> Sewer Regulators R4 and Division 1 —GENERAL REQUIREMENTS May 2017 <br /> R39 Modifications <br /> WO No—UP3633 SP-101 <br />
