• <br /> D. Any agreement to provide monetary contributions in <br /> accordance with the provisions of this ordinance shall be in a <br /> form approved by the City Attorney. <br /> be and the same is hereby amended to read as follows: <br /> Section 9: <br /> A. The Traffic Analysis shall identify and/or include <br /> the following four elements: (1 ) the required transportation <br /> system improvements as required by this ordinance; (2) the <br /> associated planning level cost estimates for said improvements; <br /> (3) When the Responsible Official determines under Subsection <br /> 9 (B) (3) of this ordinance that the required mitigating <br /> improvements may not be practical , the traffic analysis shall <br /> include an evaluation of all reasonable measures which could be <br /> included in a transportation demand management (TDM) program to <br /> further reduce traffic impacts. The traffic analysis shall also <br /> identify any potentially significant impact on any residential <br /> street; and (4) a proposed Mitigation Plan. The Mitigation Plan <br /> shall consist of a combination of the following elements as <br /> determined by the City' s Traffic Engineer (all references in <br /> this ordinance to City' s Traffic Engineer include the City <br /> Engineer) : a) proposed TDM measures and the proposed <br /> improvements required to be constructed by the applicant; b) the <br /> contribution to the City for the development' s fair share costs <br /> of identified future transportation improvements and proposed TDM <br /> measures; and c) proposed methods of compliance with the <br /> requirements of Section 10 (B) and 10 (D) , of this ordinance. <br /> The project proponent must comply with all provisions of the <br /> Mitigation Plan as approved by the Responsible Official and <br /> City' s Traffic Engineer. For the purpose of this ordinance the <br /> terms "traffic mitigation" and "transportation mitigation" are <br /> synonymous and may be used interchangeably. <br /> B. The project proponent is required to mitigate the <br /> transportation facility to an acceptable Level of Service or to <br /> maintain an acceptable Level of Service on any transportation <br /> facility in the Study Area. The acceptability of Levels of <br /> Service is defined in 1 , 2, and 3 below: <br /> 1 . Level of Service "A" through "D" is considered <br /> acceptable. <br /> 2. When the City' s Traffic Engineer and the Responsible <br /> Official determine that the required mitigating <br /> improvements, to create or maintain a Level of <br /> 5 <br />
