• <br /> Official or his authorized representative for the purpose of <br /> inspection and examination pursuant to this Code. <br /> 80-7 STOP ORDERS. Whenever any work is being done contrary to <br /> the provisions of this Code, the Building Official may order the <br /> work stopped by notice in writing served on any persons engaged <br /> in doing or causing such work to be done and any such persons <br /> shall forthwith stop such work until authorized by the Building <br /> Official to proceed with the work. <br /> 80-8 LIABILITY. The Building Official or any employee charged <br /> with the enforcement of this Code, acting in good faith and <br /> without malice for the City in the discharge of his duties, shall <br /> not thereby render himself liable personally and he is hereby <br /> relieved from all personal liability for any damage that may <br /> accrue to person or property as a result of any act required or <br /> by reason of any act or omission in the discharge of his duties. <br /> Any suit brought against the Building Official or employee, <br /> because of such act or omission performed by him in the <br /> enforcement of any provisions of this Code, shall be defended by <br /> the legal department of the City until final termination of the <br /> proceedings. This code is one of general application and nothing <br /> herein is intended to create liability or cause action running in <br /> favor of individual members of the public. <br /> 80-9 UNSAFE CONDITIONS. All electrical wires, equipment and <br /> apparatus which are unsafe or not provided with adequate <br /> safeguards, or which constitute a fire hazard, or are otherwise <br /> dangerous to human life, or which in relation to existing use <br /> constitute a hazard to safety or health, or public welfare, by <br /> reason of inadequate maintenance, obsolescence, fire hazard, <br /> disaster damage, or abandonment, as specified in this Code or any <br /> other effective ordinance are, for the purpose of this section, <br /> considered unsafe conditions. All such unsafe conditions are <br /> hereby declared to be public nuisances and the owner or his agent <br /> must abate by repair, rehabilitation, demolition, or removal in <br /> accordance with this Code or by any other procedures provided by <br /> law. <br /> 80-10 BOARD OF APPEALS. In order to determine the suitability <br /> of alternate materials and methods of construction, to provide <br /> for reasonable interpretations of this Code and to hear appeals <br /> from orders issued by the City's Building Official, the Board of <br /> Appeals created pursuant to Ordinance No. 351-75 shall hear these <br /> matters. Appeals from written orders of the Building Official <br /> must be filed within thirty (30) calendar days from the date of <br /> receipt of the written order by the aggrieved party. Such time <br /> limitation shall not apply to oral orders or directions given by <br /> the Building Official. The aggrieved party shall cause to be <br /> made at his own expense any tests or research required to <br /> substantiate his claim. <br /> 3 <br />
