1 3. When the City' s Traffic Engineer and the Responsible <br /> Official determine that the required mitigating <br /> 2 improvements to create or maintain a Level of Service <br /> of "D" or better may not be practical , City Council <br /> 3 may make a determination that Level of Service "E" or <br /> "F" is acceptable in conjunction with consideration <br /> 4 of a Local Transportation Plan. Consideration of a <br /> proposal to accept a Level of Service of "E" or "F" <br /> 5 and consideration of a Local Transportation Plan <br /> shall be made following a public hearing. <br /> 6 Notification for the hearing shall be provided in the <br /> City's official public newspaper. In addition, <br /> 7 notification shall be provided to those <br /> parties/persons required to be notified pursuant to <br /> 8 the City' s SEPA ordinance, all affected recognized <br /> Neighborhood Organizations and any other party/person <br /> 9 deemed appropriate by the Responsible Official . <br /> 10 C. The development's fair share cost to the City for the <br /> required future transportation improvements shall be determined <br /> 11 by the summation of the following two types of facility <br /> improvements (inclusions of county, state and/or other city <br /> 12 facilities shall be required when the City's Traffic Engineer <br /> deems it appropriate) : <br /> 13 <br /> 1 . Where the need to provide mitigations on a facility <br /> 14 is directly related to the developments traffic and <br /> would not be required at the horizon year if the <br /> 15 development was not constructed, the cost for the <br /> mitigation(s) will be entirely borne by the <br /> 16 development. Additionally or in lieu of payment, the <br /> Traffic Engineer and Responsible Official may require <br /> 17 that the development design to City standards and <br /> construct the improvement. The Traffic Engineer and <br /> 18 the Responsible Official shall make the determination <br /> when said construction is to be completed. In the <br /> 19 event the City's Traffic Engineer identifies more <br /> than one development under simultaneous review, <br /> 20 cumulative impacts and distribution of mitigation <br /> costs shall be considered; and <br /> 21 <br /> 2. Where the need to provide mitigations on a facility <br /> 22 by the horizon year is needed regardless of the <br /> proposed development and: <br /> 23 <br /> a. the current level of Service is "D" or better, <br /> 24 the traffic impacts of the development will be <br /> considered mitigated by a contribution of a <br /> 25 share of the costs for the improvements based <br /> on the development' s percentage of, the total <br /> 26 peak hour traffic trips at the horizon year on <br /> the facility less existing peak hour traffic <br /> 27 volume; or <br /> 28 b. the current Level of Service is "E" or "F" , the <br /> traffic impacts of the development will be <br /> 29 considered mitigated by a contribution of a <br /> share of the costs for the improvements based <br /> 30 on the development' s percentage of the total <br /> peak hour traffic trips at the horizon year on <br /> 31 the facility. <br /> 32 <br /> 5 <br />
