Any agreement to provide monetary contributions in <br /> accordance with the provisions of this ordinance shall be in a <br /> 2 form approved by the City Attorney. <br /> 3 <br /> Section 6: That Section 10 of Ordinance No. 1670-89 which reads as <br /> 4 <br /> follows: <br /> 5 <br /> 6 Section 10: Upon completion of the traffic impacts analysis <br /> and approval by the City's Traffic Engineer, the project <br /> 7 proponent has the following options: <br /> 8 A. Not to proceed with the project; <br /> 9 B. Modify the project to avoid or reduce the identified <br /> impacts. The appropriateness of measures which may reduce <br /> 10 impacts must in each case be approved by the City Traffic <br /> Engineer. Such possible measures include but are not limited to <br /> 11 van/car pooling programs, incentives to encourage mass transit <br /> ridership or other measures which in the opinion of the City <br /> 12 Traffic Engineer would lessen the traffic impact of the proposed <br /> development; <br /> 13 <br /> C. If a DNS is issued and the project receives City <br /> 14 approval on all non-transportation related issues, proceed with <br /> the project and implement the measures to mitigate the adverse <br /> 15 transportation impacts in accordance with the analysis as <br /> approved by the City' s Traffic Engineer; and/or <br /> 16 <br /> D. Enter into such other contractual arrangements <br /> 17 including but not limited to latecomer agreements or such other <br /> alternatives offered by the project proponent which are <br /> 18 satisfactory to the City having the effect of mitigating <br /> identified adverse transportation impacts of the development. <br /> 19 Any agreements must be on forms approved by the City Attorney's <br /> Office. <br /> 20 <br /> 21 be and the same is hereby amended to read as follows: <br /> 22 <br /> Section 10: Upon completion of the traffic impacts analysis <br /> 23 and approval by the City's Traffic Engineer, the project <br /> proponent has the following options: <br /> 24 <br /> A.
