. I <br /> Authority. <br /> is hereby amended to read: <br /> D. Development Activity Within the Minimum Buffers. <br /> 1. Prior to issuance of permits for clearing, grading, <br /> filling, or construction, all wetlands, streams, lakes and <br /> their minimum required buffer areas shallbe enclosed or <br /> otherwise protected by a barricade which will prevent <br /> encroachment into and damage to the wetland, stream, lake or <br /> buffer area. Permits for clearing, grading or filling <br /> within the minimum setbacks established by Subsection 17_ 1nn <br /> or Subsection 37 . 150 shall not be issued unless such <br /> clearing, grading, or filling is part of a development on <br /> the site which has been approved by the applicable Review <br /> Authority. <br /> SECTION 25: <br /> Section 37. 160 .D. 2.a of Ordinance 1671-89, which reads: <br /> 2. Grading or Filling. <br /> a. GPnPral _ Grading and filling within the minimum buffers <br /> established in Subsection 37.090.0 of this Section shall not <br /> be permitted except as provided by this Subsection. <br /> is hereby amended to read: <br /> 2 . Grading or Filling. <br /> a. General _ Grading and filling within the minimum buffers <br /> established in Subsection 17 - inn of this Section shall not <br /> be permitted except as provided by this Subsection. <br /> SECTION 26: <br /> Section 37. 160 .D. 3 of Ordinance 1671-89, which reads: <br /> 3 . StrunturPs and TmprrvPments. The City may, using Review <br /> Process II .B, allow structures and improvements to be <br /> located within a buffer area established in Subsection <br /> 37. 160.0 only under one of the following circumstances: <br /> a. For public roads, utility improvements and structures; <br /> b. For passive recreation improvements and structures, not <br /> to include decks, patios, docks, boathouses, utility sheds, <br /> or other buildings except as otherwise permitted or required <br /> under the Shoreline Master Program; <br /> c. When the setback buffer is being created as part of a <br /> wetland mitigation proposal ; <br /> d. To allow for reasonable use of the property and shall be <br /> limited to the minimum necessary to allow for reasonable use <br /> of the property; <br /> e. When required to provide public access to the shoreline <br /> by an approved shoreline permit; or <br /> f. When part of a public park or public trail system. <br />
