b. There shall be one tree planted for each <br /> sixty-four (64 ) square feet of landscape <br /> area. Up to 100 percent of the trees may be <br /> deciduous. All evergreen trees shall be a <br /> minimum of 6 feet in height at time of <br /> planting. All deciduous trees shall be a <br /> minimum of 1-1/2 inches in caliper at time of <br /> planting. <br /> c. Shrubs and groundcover shall be provided in <br /> the required landscape areas. Shrubs shall <br /> be planted at a density of 5 per 100 square <br /> feet of landscape area. Up to fifty (50) <br /> percent of the shrubs may be deciduous. <br /> Ground cover shall be planted so as to <br /> provide ninety (90) percent coverage within <br /> three years of planting. <br /> d. No parking stall shall be located more than <br /> 50 feet from a landscape area. <br /> e. Parking lot landscaping shall not block sight <br /> visibility for drivers at aisle ends, corners <br /> or intersecting traffic lanes within the <br /> parking lot. <br /> n. DNR Permits: Prior to clearing the site, the <br /> Applicant must obtain permits from the Department of <br /> Natural Resources as required. <br /> o. Assurance Devices in Native Growth Protection <br /> Easement Areas and Buffers: <br /> 1. Removal of Vegetation: Removal of trees and <br /> other vegetation within the native growth <br /> protection easement areas or buffers will not be <br /> permitted, except as specifically allowed in this <br /> agreement. A fee of $1,000 per tree will be <br /> assessed by the City for each tree cut by the <br /> property owner ( "property owner" includes the <br /> property owner, his contractor, representative or <br /> agent) which violates the provisions of this <br /> agreement. If the property owner wants to <br /> dispute the assessment of the $1,000 fee, the <br /> property owner must file an appeal with the <br /> City's Land Use Hearing Examiner within 10 days <br /> of the date of imposition of the fee by the City. <br /> In addition, restoration will be required. <br /> Restoration shall include: <br /> a. The replacement of all improperly removed <br /> ground cover with species similar to those <br /> which were removed or other approved <br /> species such that the biological and <br /> habitat values will be replaced; <br /> b. For each tree which was improperly cut <br /> and/or removed, replacement planting of a <br /> tree of equal size, quality and specie or <br /> up to three (3 ) trees of the same species <br /> in the immediate vicinity of the tree(s) <br /> which was removed. The replacement trees <br /> will be of sufficient caliper/height to <br /> adequately replace the lost tree(s) or a <br /> minimum of three (3 ) inches in caliper for <br /> deciduous trees and a minimum of 6 feet in <br /> height for evergreen trees. <br /> 8 <br />
