1 b. A tow operator, on rotation, that is unable to <br /> dispatch within the stated time will forfeit its turn <br /> 2 and be placed at the bottom of the rotation list as <br /> if he had responded. <br /> 3 c. Consistent refusal or failure of a "Class A" licensee <br /> 4 to respond to calls from the Everett Police <br /> Department for towing services may result in the <br /> 5 suspension or revocation from the list of "Class A" <br /> licensees used for police requested towing services. <br /> 6 d. Unreasonable delays in arrival shall be duly recorded <br /> 7 by officers and may be reason for deletion from the <br /> list of "Class A" licensees used for police requested <br /> 8 towing services . <br /> 9 4. The tow operator will advise the Police Department when he <br /> 10 receives a private call for a tow and the circumstances <br /> indicate that the tow is for a vehicle which has been <br /> 11 involved in an accident or other such incident on the <br /> public roadway. The tow operator also will advise the <br /> 12 Police Department of all accidents or incidents on private <br /> property resulting in bodily injury or death when the <br /> 13 operator has received a private call for a tow at such an <br /> accident or incident. <br /> 14 <br /> 5. The tow operator will notify the Police Department before <br /> 15 moving any vehicle involved in an accident or incident on a <br /> public highway as defined in the Motor Vehicle Code, <br /> 16 Chapter 46 RCW, or where it appears that the driver of the <br /> vehicle to be moved is under the influence of intoxicants <br /> 17 or drugs or is otherwise incapacitated. <br /> 18 6. When the Police Department is in charge of an accident <br /> scene or other such incident, a tow operator shall not <br /> 19 respond to such scene unless his services have been <br /> specifically requested by the Police Department or the <br /> 20 driver/owner of their agent. <br /> 21 7. The tow operator shall be available twenty-four (24) hours <br /> a day for the purpose of receiving calls and releasing <br /> 22 vehicles. Business hours will be posted conspicuously at <br /> the operator's place of business so they can be seen during <br /> 23 business hours and non-business hours. A copy will also be <br /> sent to the City Clerk and Chief of Police. Changes of <br /> 24 business hours will be sent to the City Clerk and Chief of <br /> Police ten (10) days before their effective date. <br /> 25 <br /> 8. The tow operator shall have a secure storage area for the <br /> 26 vehicles stored by the operator at the request of the <br /> Police Department. Such storage area shall comply with <br /> 27 Department of Licensing requirements for registered <br /> disposers (WAC 308-61-110). Repeated losses or thefts of <br /> 28 property from stored vehicles may result in denial , <br /> suspension, or revocation of a tow operator's letter of <br /> 29 appointment. <br /> 30 9. Tow operators will notify the Police Department of the <br /> release of stored vehicles within twenty-four 24 hours <br /> 31 after the release of such vehicle. Notification to the <br /> Police Department will be made in such a manner prescribed <br /> 32 by the Chief of Police. <br /> 12 <br />
