• <br /> 1 Section 19: SEVERABILITY. <br /> 2 Should any section, subsection, paragraph, sentence, clause or phrase <br /> 3 of this ordinance or its application to any person or situation be declared <br /> 4 unconstitutional or invalid for any reason, such decision shall not affect <br /> 5 the validity of the remaining portions of this ordinance or its application <br /> 6 to any other person or situation. The City Council of the City of Everett <br /> 7 hereby declares that it would nave adopted this ordinance and each section, <br /> 8 subsection, sentence, clause, phrase or portion thereof irrespective of the <br /> 9 fact that any one or more sections, subsections, sentences, clauses, phrases <br /> 10 or portions be declared invalid or unconstitutional . <br /> 11 Section 20: NO VESTED RIGHT TO DO POLICE IMPOUNDS. <br /> 12 Nothing in this ordinance shall proscribe the City from contracting <br /> 13 with one or more tow operators for tow services requested by the police <br /> 14 and/or providing such towing services with City personnel and equipment. It <br /> 15 is the intent of this ordinance to establish certain requirements for tow <br /> 16 business licensees and those licensees authorized to do police impounds, but <br /> 17 not to vest any specific rights to do police impounds or other police <br /> 18 requested towing services. <br /> 19 Section 21 : CITY NON-LIABILITY. <br /> 20 A. It is expressly the purpose of this ordinance to provide for and <br /> 21 promote the health, safety and welfare of the general public, and not to <br /> 22 create or otherwise establish or designate any particular class or group of <br /> 23 persons who will or should be especially protected or benefited by the terms <br /> 24 of this ordinance. <br /> 25 B. It is the specific intent of this ordinance that no provision nor <br /> 26 term used in this ordinance is intended to impose any duty whatsoever upon <br /> 27 the City or any of its officers or employees. <br /> 28 C. Nothing contained in this ordinance is intended to be nor shall <br /> 29 be construed to create or form the basis for any liability on the part of <br /> 30 the City, or its officers, employees or agents, for any injury or damage <br /> 31 resulting from the failure to comply with the provisions of this ordinance, <br /> 32 <br /> 14 <br />
