1 or by reason or in consequence of any inspection, notice, order, <br /> 2 certificate, permission or approval authorized or issued or done in <br /> 3 connection with the implementation or enforcement of this ordinance, or by <br /> 4 reason of any action or inaction on the part of the City related in any <br /> 5 manner to the enforcement of this ordinance by its officers, employees or <br /> 6 agents. <br /> 7 Section 22: VIOLATION - PENALTY. <br /> 8 Any person, firm or corporation, or any agent thereof violating any <br /> 9 provision of this ordinance except for Sections 17(A)(2) , 17 (A)(3) and <br /> 10 17(B) shall be guilty of a misdemeanor, and each such person shall be deemed <br /> 11 guilty of a separate offense for each and every day during which any <br /> 12 violation of any of the provisions of this ordinance is committed, <br /> 13 continued, or permitted; and upon conviction of any such violation, such <br /> 14 person shall be subject to a fine of not more than One Thousand Dollars <br /> 15 ($1 ,000) or imprisonment for not more than ninety (90) days, or both such <br /> 16 fine and imprisonment. <br /> 17 A. Violation. Injunction Action. Any violation of the provisions <br /> 18 of this ordinance constitutes a public nuisance which the City can abate by <br /> 19 an action in Snohomish County Superior Court. The costs of such action <br /> 20 shall be taxed against the violator. <br /> 21 B. Civil Penalty. In addition to or as an alternative to any <br /> 22 other penalty provided herein or by law any person who violates any <br /> 23 provision of this ordinance shall be subject to a civil penalty in an amount <br /> 24 not to exceed Two Hundred Fifty Dollars ($250) per violation. The penalty <br /> 25 assessed may be varied to consider the appropriateness of the penalty to the <br /> 26 violator; the gravity of the violation; the number of past and present <br /> 27 violations committed and the good faith of the violator in attempting to <br /> 28 achieve compliance after notification of the violation. All civil penalties <br /> 29 assessed will be enforced and collected in accordance with the procedure <br /> 30 specified herein and in accordance with the rules promulgated hereunder. <br /> 31 <br /> 32 <br /> 15 <br />
