Exhibit A <br /> Continued <br /> Task 4.2 Prepare Biological Assessment <br /> A Biological Assessment will be prepared for the project for compliance with the Endangered <br /> Species Act (ESA) and the Magnuson-Stevens Fishery Conservation and Management Act <br /> (Magnusson-Stevens Act). Union Slough contains designated critical habitat for Chinook salmon, <br /> steelhead, and bull trout, and as such, the project is expected to go to formal consultation with the <br /> National Oceanic and Atmospheric Administration and the U.S. Fish and Wildlife Service due to <br /> anticipated impacts to fish habitat.The BA will also evaluate impacts to Essential Fish Habitat for <br /> compliance with the Magnusson-Stevens Act. <br /> Assumptions: <br /> • The project may result in a May Affect,Not Likely to Adversely Affect determination for listed <br /> species and designated critical habitat that occur in the project action area. <br /> • City will provide comments on the Draft BA during one round of review prior to Otak <br /> completing the Final BA for submission with the JARPA package. <br /> • 1 meeting with regulatory agencies to support the City during permitting and preparation of the <br /> BA is included in this scope. <br /> Deliverables: <br /> • Draft and Final Biological Assessment <br /> Task 4.3 Cultural Resources Investigation and Report (Cultural Resource Consultants) <br /> The sub-consultant (Cultural Resource Consultants) (CRC)will perform a cultural resources survey <br /> and provide a report of the findings for compliance with Section 106 of the National Historic <br /> Preservation Act (Appendix B). <br /> Task 5 —Final Construction Documents <br /> Plans will be submitted at the 90 percent and 100 percent design levels for review and comment by <br /> the City and DD5. Each submittal will be provided to the City's project team in electronic (PDF <br /> file) format or other reproducible electronic format. When the 100 percent design plan set has been <br /> approved by the City and DD5, Otak will provide a full-size .pdf set, sealed by a Washington state <br /> registered Professional Engineer (PE), or Professional Land Surveyor (PLS) as appropriate,with <br /> electronic files in AutoCAD. <br /> After the City's project team has reviewed the 90 percent submittal, a meeting will be held at the <br /> City of Everett to discuss review comments.
