• <br /> • <br /> 1 Section 3: DECLARATION OF PUBLIC NUISANCE. <br /> 2 Any property found to be maintained in violation of Section 2 is hereby <br /> 3 declared to be a public nuisance and shall be abated by rehabilitation, <br /> 4 removal , trimming, demolition or repair pursuant to the procedures set forth <br /> 5 herein. The procedures for abatement set forth herein shall not be <br /> 6 exclusive and shall not in any manner limit or restrict the City from <br /> 7 enforcing other City ordinances or abating public nuisances in any other <br /> 8 manner provided by law. <br /> 9 Section 4: ABATEMENT PROCEDURE. <br /> 10 A. NOTIFICATION OF NUISANCE. Whenever the City' s Code Compliance <br /> 11 Officer determines that any property within the City is being maintained <br /> 12 contrary to one or more of the provisions of Section 2, he/she shall provide <br /> 13 written notice ( "Notice to Abate" ) to the owner of said property stating the <br /> 14 section(s) being violated. Such notice shall set forth a reasonable time <br /> 15 limit, in no event less than five (5) calendar days, for correcting the <br /> 16 violation(s) and may also set forth suggested methods of correcting the <br /> 17 same. Provided, however, in the event the Code Compliance Officer <br /> 18 determines that an imminent health and/or safety problem exists, then the <br /> 19 Code Compliance Officer may require immediate correction of the violation. <br /> 20 Such notice shall be served upon the owner. Notice shall be served in <br /> 21 person or by certified mail , return receipt requested. <br /> 22 B. ADMINISTRATIVE HEARING TO ABATE NUISANCE. In the event said <br /> 23 owner shall fail , neglect or refuse to comply with the "Notice to Abate," <br /> 24 the City's Violations Hearing Examiner as created by Ordinance No. 1383-87 <br /> 25 and in accordance with Section 4(A-G) of Ordinance No. 1383-87 as amended, <br /> 26 shall conduct a hearing to ascertain whether said violation constitutes a <br /> 27 public nuisance in accordance with the provisions of this ordinance. <br /> 28 C. NOTICE OF HEARING. Notice of said hearing shall be served upon <br /> 29 the owner of said property not less than five (5) calendar days before the <br /> 30 time fixed for hearing. Notice shall be served in person or by certified <br /> 31 mail , return receipt requested. Notice shall be substantially in the format <br /> 32 set forth below: <br /> 3 <br />
