• <br /> 1 Hearing Examiner shall prepare findings and an order, which shall specify <br /> 2 the nature of the nuisance, the method(s) of abatement and the time within <br /> 3 which the work shall be commenced and completed. The order shall include <br /> 4 reference to the right to appeal set forth in Section 4(F). A copy of the <br /> 5 findings and order shall be served on the owner of the subject property in <br /> 6 accordance with the provisions of Section 4(C) . In addition, a copy of the <br /> 7 findings and order shall be forthwith posted on or near the property. <br /> 8 E. PROCEDURE - NO APPEAL. In the absence of any appeal , the public <br /> 9 nuisance shall be abated in the manner and means specifically set forth in <br /> 10 said findings and order. Upon abatement in full by the owner, the <br /> 11 proceedings hereunder shall terminate. In the event the owner fails to <br /> 12 abate the nuisance as ordered by the Violations Hearing Examiner, the <br /> 13 nuisance shall be abated by City employees or by private contract. The <br /> 14 costs shall be billed to the owner, as specified herein. <br /> 15 F. PROCEDURE - APPEAL. Action taken by the Violations Hearing <br /> 16 Examiner constitutes a decision and is appealable to the Snohomish County <br /> 17 Superior Court; provided that any petition for review shall be filed no <br /> 18 later than fifteen (15) days after the service of the Order. Service of an <br /> 19 Order may be made either personally or by mailing by certified mail , return <br /> 20 receipt requested, a copy of the Order to the owner. Proof of service shall <br /> 21 be made by a written declaration under penalty of perjury by the person <br /> 22 effecting the service, declaring the time and date of service and the manner <br /> 23 by which service was made. <br /> 24 Copies of the petition for review shall be served on the City as in all <br /> 25 civil actions. The filing of the petition shall not stay enforcement of the <br /> 26 Examiner' s Order except by order of the Superior Court and on posting of a <br /> 27 bond to be determined by the court naming the City as beneficiary. The <br /> 28 review shall be conducted by the court without a jury. The record shall be <br /> 29 satisfied by a narrative report certified by the Violations Hearing Examiner <br /> 30 and no verbatim record of proceedings before the Violations Hearing Examiner <br /> 31 shall be required to be presented to the Superior Court unless the court <br /> 32 <br /> 5 <br />
