• <br /> 1 specifically requires such. The court may affirm the Order or remand the <br /> 2 case for further proceedings; or it may reverse the Order if the substantial <br /> 3 rights of the petitioners may have been prejudiced because the findings, <br /> 4 conclusions and decision are determined to be arbitrary, capricious or <br /> 5 contrary to law. <br /> 6 G. ABATEMENT BY CITY. <br /> 7 1 . If such nuisance is not abated as ordered within said abatement <br /> 8 period, the City shall cause the same to be abated by City employees or <br /> 9 private contract. The City, its employees and agents are expressly <br /> 10 authorized to enter upon said property for such purposes. The cost, <br /> 11 including incidental expenses, of abating the nuisance shall be billed to <br /> 12 the owner and shall become due and payable thirty (30) days thereafter. The <br /> 13 term "incidental expenses" shall include, but not be limited to, personnel <br /> 14 costs, both direct and indirect, including attorney' s fees; costs incurred <br /> 15 in documenting the nuisance; the actual expenses and costs of the City in <br /> 16 the preparation of notices, specifications and contracts, and in inspecting <br /> 17 the work; and the costs of printing and mailing required hereunder. <br /> 18 2. No person shall obstruct, impede, or interfere with the City, its <br /> 19 employees or agents, or with any person who owns, or holds any interest or <br /> 20 estate in any property in the performance of any necessary act, preliminary <br /> 21 to or incidental , carrying out an abatement order issued pursuant to this <br /> 22 ordinance. <br /> 23 Section 5: LIEN PROCEDURE. <br /> 24 A. RECORD OF COST OF ABATEMENT. In the event the property owner <br /> 25 fails to pay within the thirty (30) day period set forth in Section 4(G)(1 ) , <br /> 26 the Code Compliance Officer shall render an itemized report in writing to <br /> 27 the City Council showing the cost of abatement, including the <br /> 28 rehabilitation, demolition or repair of said property, including any salvage <br /> 29 value relating thereto; provided that before said report is submitted to the <br /> 30 City Council , a copy of the same shall be posted for at least five (5) days <br /> 31 upon or in front of such property, together with a notice of the time when <br /> 32 <br /> 6 <br />
