1 1 . That the vehicle has received five (5) or more <br /> parking violations within a six month period; and <br /> 2 <br /> 2. That there are no defenses nor extenuating or <br /> 3 mitigating factors justifying the non-imposition of a <br /> repeat violator designation. <br /> 4 <br /> To the extent that any parking violations were received by <br /> 5 said vehicle prior to change in ownership, said violations <br /> incurred by the prior owner will not be considered by the <br /> 6 Hearing Examiner in determining whether the required number <br /> of parking violations exist. However, in determining <br /> 7 whether the required number of violations exist, the <br /> Hearing Examiner is authorized to consider all parking <br /> 8 violations incurred by the violator prior to the date of <br /> hearing. The fact that all or a portion of the parking <br /> 9 violations have been paid will not constitute a defense nor <br /> extenuating or mitigating factor. A parking violation <br /> 10 which has been released by the City or dismissed by the <br /> Hearing Examiner will not be counted as a violation for <br /> 11 purposes of this section. <br /> 12 Upon the Hearing Examiner's entry of an order declaring a <br /> vehicle to be a repeat violator, the order shall remain in <br /> 13 effect for one hundred and eighty (180) days during which <br /> period a parking violation issued to a repeat violator will <br /> 14 not be entitled to the reduction in penalty as is set forth <br /> in Subsection C. In order for the repeat violator status <br /> 15 to be removed from an offending vehicle, a period of one <br /> hundred and eighty (180) days must elapse during which time <br /> 16 the vehicle receives two (2) or less City parking <br /> violations. Should this requirement be met, the repeat <br /> 17 violator status will be automatically removed by the City <br /> and the City will mail notice of such to the registered and <br /> 18 legal owners of the vehicle as shown by the records of the <br /> State of Washington' s Department of Licenses. However, <br /> 19 anytime during this one hundred and eighty (180) day period <br /> that the offending vehicle receives a third parking <br /> 20 violation, an additional one hundred and eighty day (180) <br /> day period will commence to run from the date that the <br /> 21 third violation is received and will continue to run until <br /> a period of one hundred and eighty (180) days elapses <br /> 22 during which time the vehicle receives two (2) or less <br /> parking violations. <br /> 23 <br /> 24 Section 2: Ordinance No. 994-83 is hereby amended by the addition of <br /> 25 the following: <br /> 26 In the event any person paying a parking violation to the City <br /> places in the parking envelope less money than is required for <br /> 27 the parking violation, the City is entitled to assess an <br /> additional penalty in the amount of the deficiency plus ten ($10) <br /> 28 dollars which the violator shall be responsible for paying. <br /> 29 <br /> Section 3: Ordinance No. 994-83 is hereby amended by the addition of <br /> 30 the following: <br /> 31 <br /> 32 <br /> 4 <br />
