• <br /> • <br /> 1 alcohol and/or drugs or whose conduct poses a physical danger to the safety <br /> 2 of others present; or <br /> 3 D. Violated any of the provisions of this Chapter; or <br /> 4 E. Committed any act which is a ground for denial of a license. <br /> 5 When the City Clerk suspends or revokes a license, the City Clerk shall <br /> 6 first provide the licensee with a Notice of Proposed Suspension/Revocation <br /> 7 which shall provide notification to the licensee that a hearing will be held <br /> 8 on the revocation/suspension at a time or date determined by the City <br /> 9 Clerk. The Notice of Proposed Suspension/Revocation will be sent to the <br /> 10 licensee at the address found on the licensee's application. It is the <br /> 11 licensee' s duty to keep the address information on the application current <br /> 12 at all times . The City Clerk or designee will preside over the hearing. In <br /> 13 the event the licensee fails to attend the hearing, the license will <br /> 14 automatically be revoked/suspended. Any revocation/suspension will not be <br /> 15 effective until the City Clerk makes a determination following the hearing. <br /> 16 Notwithstanding the above, a license suspension/revocation shall become <br /> 17 effective immediately without the benefit of any pre-suspension/revocation <br /> 18 hearing when the ordinance requires a summary revocation/suspension or when <br /> 19 the City Clerk determines that it is in the best interest of the health, <br /> 20 safety and/or welfare of the citizens of Everett to do so. <br /> 21 Within ten (10) days following revocation or suspension of any license <br /> 22 issued pursuant to this ordinance, or within ten days following the denial <br /> 23 of any license regulated by this Chapter, an appeal may be filed with the <br /> 24 City Council . Upon the receipt of such notice, the licensee shall be <br /> 25 afforded a hearing before the City Council after reasonable notice has been <br /> 26 given. Said appeal shall be in writing and addressed to the City Council , <br /> 27 "ATTENTION: City Clerk." Notice of the time and date of such appeal <br /> 28 hearing shall be given by delivering a copy of the notice to the holder of <br /> 29 the license or by mailing a copy thereof to the holder at his last address <br /> 30 shown by the City Clerk 's license records. The City Council shall , at the <br /> 31 conclusion of such hearing or within thirty (30) days thereafter, issue a <br /> 32 <br /> 6 <br />
