• <br /> 1 B. It is the specific intent of this ordinance that no provision nor term <br /> used in this ordinance is intended to impose any duty whatsoever upon <br /> 2 the City or any of its officers or employees, for whom the <br /> implementation or enforcement of this ordinance shall be discretionary <br /> 3 and not mandatory. <br /> 4 C. Nothing contained in this ordinance is intended to be nor shall be <br /> construed to create or form the basis for any liability on the part of <br /> 5 the city, or its officers, employees or agents, for any injury or <br /> damage resulting from the failure to comply with the provisions of this <br /> 6 ordinance, or by reason or in consequence of any inspection, notice, <br /> order, certificate, permission or approval authorized or issued or done <br /> 7 in connection with the implementation or enforcement of this ordinance, <br /> or by reason of any action or inaction on the part of the City related <br /> 8 in any manner to the enforcement of this ordinance by its officers, <br /> employees or agents. <br /> 9 <br /> 10 Section 25: VIOLATION - PENALTY <br /> 11 Any person, firm or corporation violating any provision of this <br /> 12 ordinance shall be guilty of a misdemeanor, and each such person shall be <br /> 13 deemed guilty of a separate offense for each and every day during which any <br /> 14 violation of any of the provisions of this ordinance is committed, <br /> 15 continued, or permitted; and upon conviction of any such violation, such <br /> 16 person shall be subject to a fine of not more than one thousand dollars <br /> 17 ($1 ,000) or imprisonment for not more than ninety days, or both such fine <br /> 18 and imprisonment. <br /> 19 <br /> A. Violation. Injunction action. Any violation of the provisions of <br /> 20 this ordinance constitutes a public nuisance which the City can abate <br /> by an action in Snohomish County Superior Court. The costs of such <br /> 21 action shall be taxed against the violator. <br /> 22 B. Civil penalty. In addition to or as an alternative to any other <br /> penalty provided herein or by law any person who violates any provision <br /> 23 of this ordinance shall be subject to a civil penalty in an amount not <br /> to exceed two hundred fifty dollars per violation to be directly <br /> 24 assessed by the Director of Weights and Measures. The Director, in a <br /> reasonable manner, may vary the amount of the penalty assessed to <br /> 25 consider the appropriateness of the penalty to the violator; the <br /> gravity of the violation; the number of past and present violations <br /> 26 committed and the good faith of the violator in attempting to achieve <br /> compliance after notification of the violation. All civil penalties <br /> 27 assessed will be enforced and collected in accordance with the <br /> procedure specified herein and in accordance with the rules promulgated <br /> 28 hereunder. <br /> 29 C. Provisions Nonexclusive. Penalty and enforcement provisions provided <br /> in this article are not exclusive, and the City may pursue any remedy <br /> 30 or relief it deems appropriate. <br /> 31 <br /> 32 <br /> 13 <br />
