1 Section 7: LIMOUSINE BUSINESS LICENSE - ISSUANCE, RENEWAL, DENIAL, SUSPENSION AND REVOCATION 2 A. It is unlawful to own or operate a limousine service, or engage in the 3 business of operating a limousine in the City of Everett without first having obtained a license from the City Clerk covering each and every 4 vehicle so used to be known as a limousine license. 5 B. A license will be denied to any person if the City Clerk, after due investigation, finds�at the applicant or the owner has done any of 6 the following: 7 1 . Made any false statement on the application or omitted information required on the application; 8 2. Had a conviction or bail forfeiture involving crimes pertaining 9 to alcohol , controlled substances, prostitution, gambling, physical violence, or crimes directly related to the applicant's 10 honesty and integrity (fraud, larceny, extortion, theft, etc. ) and ablility to properly operate a for-hire vehicle business, 11 within three years of the date of application; 12 3. Exhibited conduct within the past three years in driving, operating or engaging in the business of operating any limousine 13 which would lead the City Clerk to reasonably conclude that the applicant will not comply with ordinance requirements relating to 14 vehicle safety and sanitation standards, insurance requirements, or vehicle and driver licensing requirements; 15 4. Been refused a limousine license or had such license or for-hire 16 license denied or revoked; provided, however, that any applicant denied a license under the provisions of this ordinance may 17 reapply after one year from the denial if the basis for denial no longer exists; 18 5. Engaged in the business of operating any limousine for which a 19 license is required, while unlicensed or on a license suspension; 20 6. Used, or authorized to be used, a trade name, or other identification upon a limousine or in any advertising or public 21 listing, which was likely to be confused with the registered trade name, scheme, or identification of another licensee or 22 which tended to deceive or mislead the public as to the type of service offered; 23 7. Failed to provide insurance coverage as required herein; or 24 8. Been determined to be unfit to conduct the business. 25 C. A limousine business license will be suspended if the licensee does any 26 of the following: 27 1 . Fails to maintain in full force and effect the insurance required in this ordinance; 28 2. Authorizes any person to drive a limousine which is not equipped 29 and in safe condition as required by City ordinance and the 30 requirements of this ordinance, as now or hereafter amended; 3. Allows a driver to operate a limousine owned or operated by 31 licensee when insufficiently covered by insurance; 32 4
