1 Section 7: LIMOUSINE BUSINESS LICENSE - ISSUANCE, RENEWAL, DENIAL, <br /> SUSPENSION AND REVOCATION <br /> 2 <br /> A. It is unlawful to own or operate a limousine service, or engage in the <br /> 3 business of operating a limousine in the City of Everett without first <br /> having obtained a license from the City Clerk covering each and every <br /> 4 vehicle so used to be known as a limousine license. <br /> 5 B. A license will be denied to any person if the City Clerk, after due <br /> investigation, finds�at the applicant or the owner has done any of <br /> 6 the following: <br /> 7 1 . Made any false statement on the application or omitted <br /> information required on the application; <br /> 8 <br /> 2. Had a conviction or bail forfeiture involving crimes pertaining <br /> 9 to alcohol , controlled substances, prostitution, gambling, <br /> physical violence, or crimes directly related to the applicant's <br /> 10 honesty and integrity (fraud, larceny, extortion, theft, etc. ) <br /> and ablility to properly operate a for-hire vehicle business, <br /> 11 within three years of the date of application; <br /> 12 3. Exhibited conduct within the past three years in driving, <br /> operating or engaging in the business of operating any limousine <br /> 13 which would lead the City Clerk to reasonably conclude that the <br /> applicant will not comply with ordinance requirements relating to <br /> 14 vehicle safety and sanitation standards, insurance requirements, <br /> or vehicle and driver licensing requirements; <br /> 15 <br /> 4. Been refused a limousine license or had such license or for-hire <br /> 16 license denied or revoked; provided, however, that any applicant <br /> denied a license under the provisions of this ordinance may <br /> 17 reapply after one year from the denial if the basis for denial no <br /> longer exists; <br /> 18 <br /> 5. Engaged in the business of operating any limousine for which a <br /> 19 license is required, while unlicensed or on a license suspension; <br /> 20 6. Used, or authorized to be used, a trade name, or other <br /> identification upon a limousine or in any advertising or public <br /> 21 listing, which was likely to be confused with the registered <br /> trade name, scheme, or identification of another licensee or <br /> 22 which tended to deceive or mislead the public as to the type of <br /> service offered; <br /> 23 <br /> 7. Failed to provide insurance coverage as required herein; or <br /> 24 <br /> 8. Been determined to be unfit to conduct the business. <br /> 25 <br /> C. A limousine business license will be suspended if the licensee does any <br /> 26 of the following: <br /> 27 1 . Fails to maintain in full force and effect the insurance required <br /> in this ordinance; <br /> 28 <br /> 2. Authorizes any person to drive a limousine which is not equipped <br /> 29 and in safe condition as required by City ordinance and the <br /> 30 requirements of this ordinance, as now or hereafter amended; <br /> 3. Allows a driver to operate a limousine owned or operated by <br /> 31 licensee when insufficiently covered by insurance; <br /> 32 <br /> 4 <br />
