• <br /> 1 4. Allows any person to drive a limousine which is not equipped with <br /> seat belts for all passengers; <br /> 2 5. Falsifies any information on the application; or <br /> 3 6. A limousine owned or operated by licensee's business was operated <br /> 4 without a valid limousine driver's license. <br /> 5 D. A limousine business license will be suspended or revoked if the <br /> licensee has been found to have done any of the following: <br /> 6 1 . Operated or permited the operation of the limousine while the <br /> 7 driver is using or in possession of alcohol or controlled <br /> substances, during its operation; <br /> 8 2. Falsified any record, document, or information required to be <br /> 9 kept or submitted to the City by this ordinance, or by rule or <br /> regulation prescribed hereunder; <br /> 10 3. Violated any of the provisions of this ordinance; <br /> 11 4. Violated any of the ordinances of the City or the laws of the <br /> 12 state, the violation of which reflects unfavorably on the fitness <br /> of the license holder to offer public transportation; or <br /> 13 5. Engaged in unfair methods of competition and/or unfair or <br /> 14 deceptive acts or practices. <br /> 15 Section 8: SUSPENSION, REVOCATION AND DENIAL - HEARINGS AND APPEALS <br /> 16 A. "Suspension" of a license means that the licensee's privilege to <br /> 17 operate his/her business (in the case of a limousine license) or to <br /> operate a limousine (in the case of a driver's license) is barred for a <br /> 18 specific period of time. A suspended license may be reinstated upon <br /> the lapse of a specified period of time or by correcting the <br /> 19 deficiencies. The conditions of reinstatement will be determined by <br /> the City Clerk. <br /> 20 <br /> B. "Revocation" of a license means that the license has been cancelled. A <br /> 21 licensee whose license has been revoked cannot have his license <br /> reinstated but must comply with all conditions of revocation including <br /> 22 re-applying for a new license and paying all license fees. <br /> 23 C. When the City Clerk suspends or revokes a limousine business license or <br /> driver's license, the City Clerk shall first provide the licensee with <br /> 24 a Notice of Proposed Suspension/Revocation which shall provide <br /> notification to the licensee that a hearing will be held on the <br /> 25 revocation/suspension at a time or date determined by the City Clerk. <br /> The Notice of Proposed Suspension/Revocation will be sent to the <br /> 26 licensee at the address found on the licensee' s application. It is the <br /> licensee's duty to keep the address information on the application <br /> 27 current at all times. The City Clerk will preside over the hearing. <br /> In the event the licensee fails to attend the hearing, the license will <br /> 28 automatically be revoked/suspended. Any revocation/suspension will not <br /> be effective until the City Clerk makes a determination following the <br /> 29 hearing. <br /> 30 D. Notwithstanding subsection C herein, a license suspension/revocation <br /> shall become effective immediately without the benefit of any <br /> 31 pre-suspension/revocation hearing when the ordinance requires a summary <br /> 32 <br /> 5 <br />
