• 1 4. Allows any person to drive a limousine which is not equipped with seat belts for all passengers; 2 5. Falsifies any information on the application; or 3 6. A limousine owned or operated by licensee's business was operated 4 without a valid limousine driver's license. 5 D. A limousine business license will be suspended or revoked if the licensee has been found to have done any of the following: 6 1 . Operated or permited the operation of the limousine while the 7 driver is using or in possession of alcohol or controlled substances, during its operation; 8 2. Falsified any record, document, or information required to be 9 kept or submitted to the City by this ordinance, or by rule or regulation prescribed hereunder; 10 3. Violated any of the provisions of this ordinance; 11 4. Violated any of the ordinances of the City or the laws of the 12 state, the violation of which reflects unfavorably on the fitness of the license holder to offer public transportation; or 13 5. Engaged in unfair methods of competition and/or unfair or 14 deceptive acts or practices. 15 Section 8: SUSPENSION, REVOCATION AND DENIAL - HEARINGS AND APPEALS 16 A. "Suspension" of a license means that the licensee's privilege to 17 operate his/her business (in the case of a limousine license) or to operate a limousine (in the case of a driver's license) is barred for a 18 specific period of time. A suspended license may be reinstated upon the lapse of a specified period of time or by correcting the 19 deficiencies. The conditions of reinstatement will be determined by the City Clerk. 20 B. "Revocation" of a license means that the license has been cancelled. A 21 licensee whose license has been revoked cannot have his license reinstated but must comply with all conditions of revocation including 22 re-applying for a new license and paying all license fees. 23 C. When the City Clerk suspends or revokes a limousine business license or driver's license, the City Clerk shall first provide the licensee with 24 a Notice of Proposed Suspension/Revocation which shall provide notification to the licensee that a hearing will be held on the 25 revocation/suspension at a time or date determined by the City Clerk. The Notice of Proposed Suspension/Revocation will be sent to the 26 licensee at the address found on the licensee' s application. It is the licensee's duty to keep the address information on the application 27 current at all times. The City Clerk will preside over the hearing. In the event the licensee fails to attend the hearing, the license will 28 automatically be revoked/suspended. Any revocation/suspension will not be effective until the City Clerk makes a determination following the 29 hearing. 30 D. Notwithstanding subsection C herein, a license suspension/revocation shall become effective immediately without the benefit of any 31 pre-suspension/revocation hearing when the ordinance requires a summary 32 5
