1 revocation/suspension or when the City Clerk determines that it is in <br /> the best interest of the health and/or safety of the City and its <br /> 2 citizens of Everett to do so. <br /> 3 E. Within ten days following revocation or suspension of any license <br /> issued pursuant to this ordinance, or within ten days following the <br /> 4 denial of any license regulated by this ordinance, an appeal may be <br /> filed with the City's Parking Hearing Examiner. Upon the receipt of <br /> 5 such notice, the licensee shall be afforded a hearing before the <br /> Parking Hearing Examiner after reasonable notice has been given. Said <br /> 6 appeal shall be in writing and addressed to the Parking Hearing <br /> Examiner, "ATTENTION: City Clerk." Notice of the time and date of <br /> 7 such appeal hearing shall be given by delivering a copy of the notice <br /> to the holder of the license or by mailing a copy thereof to the holder <br /> 8 at his last address as shown by the City Clerk 's license records which <br /> notice shall be mailed or delivered at least five days before the date <br /> 9 fixed for the hearing. The Parking Hearing Examiner shall , within <br /> thirty days after the conclusion of such hearing, issue a decision as <br /> 10 to the revocation, suspension or denial . Such decision of the Parking <br /> Hearing Examiner shall be final and conclusive as of the date set forth <br /> 11 in the decision, unless within fifteen (15) days from the effective <br /> date of the Parking Hearing Examiner's order an aggrieved person or <br /> 12 persons obtain a writ of certiorari from the Superior Court of <br /> Washington for Snohomish County for purpose of review of the action <br /> 13 taken. <br /> 14 It is unlawful for any person whose license has been revoked or <br /> suspended, to keep the license issued to him/her in his/her possession <br /> 15 or under his control , and the same shall immediately be surrendered to <br /> the City Clerk. When revoked, the license shall be cancelled, and when <br /> 16 suspended the City Clerk shall retain the same during the period of <br /> suspension. <br /> 17 <br /> 18 Section 9: LICENSE TRANSFERABILITY <br /> 19 No license issued pursuant to this ordinance shall be transferable <br /> 20 except in the case of a bona fide sale of the business of the owner, and <br /> 21 then only upon the filing of an application with the City requesting such <br /> 22 transfer and the applicant meeting all license requirements of this <br /> 23 ordinance. The fee for such transfer of limousine license shall be the <br /> 24 amount as set forth in Section 6 of this ordinance and shall be paid by the <br /> 25 applicant for the transfer at the time such an application is filed. <br /> 26 Section 10: LIABILITY INSURANCE <br /> 27 Prior to the issuance of any limousine business license, every <br /> 28 applicant shall file with the City Clerk proof of compliance with Chapter <br /> 29 46.72 RCW as now or hereafter amended. In addition, in the event the <br /> 30 applicant leases its limousines, the applicant shall file with the City <br /> 31 Clerk proof of insurance coverage of all of applicant's lessees. <br /> 32 <br /> 6 <br />
