4 <br /> • <br /> 1 80-5 REPORTS AND RECORDS. The Building Official shall submit a <br /> 2 report to the proper City Official not less than once a year, covering the <br /> work of the department during the preceding period. He shall incorporate <br /> in said report a summary of his recommendations as to desirable amend- <br /> 3ments to this Code. <br /> 4 The Building Official shall keep a permanent, accurate account of all fees <br /> 5 and other moneys collected and received under this Code, the names of <br /> the persons upon whose account the same were paid, the date and amount <br /> 6 thereof, together with the location of the building or premises to which <br /> they relate. <br /> 7 80-6 RIGHT OF ENTRY. Whenever necessary to make an inspection to <br /> 8 enforce any of the provisions of this Code, or whenever the Building <br /> Official or his authorized representative has reasonable cause to believe <br /> 9 that there exists in any building or upon any premises any condition or <br /> code violation which makes such building or premises unsafe, dangerous or <br /> 10 hazardous, the Building Official or his authorized representative may <br /> enter such building or premises at all reasonable times to inspect the <br /> 11 same or to perform any duty imposed upon the Building Official by this <br /> Code, provided that if such building or premises be occupied, he shall first <br /> 12 present proper credentials and request entry; and if such building or <br /> premises be unoccupied, he shall first make a reasonable effort to locate <br /> 13 the owner or other persons having charge or control of the building or <br /> premises and request entry. If such entry is refused, the Building Official <br /> 14 or his authorized representative shall have recourse to every remedy <br /> provided by law to secure entry. <br /> 15 When the Building Official or his authorized representative shall have <br /> 16 first obtained a proper inspection warrant or other remedy provided by <br /> law to secure entry, no owner or occupant or any other persons having <br /> 1 charge, care or control of any building or premises shall fail or neglect, <br /> 7 after proper request is made as herein provided, to promptly permit entry <br /> 18 therein by the Building Official or his authorized representative for the <br /> purpose of inspection and examination pursuant to this Code. <br /> 19 80-7 STOP ORDERS. Whenever any work is being done contrary to the <br /> 20 provisions of this Code, the Building Official may order the work stopped <br /> by notice in writing served on any persons engaged in the doing or causing <br /> 21 such work to be done and any such persons forthwith stop such work until <br /> authorized by the Building Official to proceed with the work. <br /> 22 80-8 LIABILITY. The Building Official or any employee charged with <br /> 23 the enforcement of this Code, acting in good faith and without malice for <br /> the City in the discharge of his duties, shall not thereby render himself <br /> 24 liable personally and he is hereby relieved from all personal liability for <br /> any damage that may accrue to persons or property as a result of any act <br /> 25 required or by reason of any act or omission in the discharge of his duties. <br /> Any suit brought against the Building Official or employee, because of <br /> 26 such act or omission performed by him in the enforcement of any <br /> provisions of this Code, shall be defended by the legal department of the <br /> 27 City until final termination of the proceedings. This Code is one of <br /> general application and nothing herein is intended to create liability or <br /> 28 cause action running in favor of individual members of the public. <br /> 20 80-9 UNSAFE CONDITIONS. All electrical wires, equipment and <br /> apparatus which are unsafe or not provided with adequate safeguards, or <br /> 30 which constitute a fire hazard, or are otherwise dangerous to human life, <br /> or which in relation to existing use constitute a hazard to safety or <br /> 31 health, or public welfare, by reason of inadequate maintenance, <br /> 32 <br /> 2 <br />
