4 • 1 80-5 REPORTS AND RECORDS. The Building Official shall submit a 2 report to the proper City Official not less than once a year, covering the work of the department during the preceding period. He shall incorporate in said report a summary of his recommendations as to desirable amend- 3ments to this Code. 4 The Building Official shall keep a permanent, accurate account of all fees 5 and other moneys collected and received under this Code, the names of the persons upon whose account the same were paid, the date and amount 6 thereof, together with the location of the building or premises to which they relate. 7 80-6 RIGHT OF ENTRY. Whenever necessary to make an inspection to 8 enforce any of the provisions of this Code, or whenever the Building Official or his authorized representative has reasonable cause to believe 9 that there exists in any building or upon any premises any condition or code violation which makes such building or premises unsafe, dangerous or 10 hazardous, the Building Official or his authorized representative may enter such building or premises at all reasonable times to inspect the 11 same or to perform any duty imposed upon the Building Official by this Code, provided that if such building or premises be occupied, he shall first 12 present proper credentials and request entry; and if such building or premises be unoccupied, he shall first make a reasonable effort to locate 13 the owner or other persons having charge or control of the building or premises and request entry. If such entry is refused, the Building Official 14 or his authorized representative shall have recourse to every remedy provided by law to secure entry. 15 When the Building Official or his authorized representative shall have 16 first obtained a proper inspection warrant or other remedy provided by law to secure entry, no owner or occupant or any other persons having 1 charge, care or control of any building or premises shall fail or neglect, 7 after proper request is made as herein provided, to promptly permit entry 18 therein by the Building Official or his authorized representative for the purpose of inspection and examination pursuant to this Code. 19 80-7 STOP ORDERS. Whenever any work is being done contrary to the 20 provisions of this Code, the Building Official may order the work stopped by notice in writing served on any persons engaged in the doing or causing 21 such work to be done and any such persons forthwith stop such work until authorized by the Building Official to proceed with the work. 22 80-8 LIABILITY. The Building Official or any employee charged with 23 the enforcement of this Code, acting in good faith and without malice for the City in the discharge of his duties, shall not thereby render himself 24 liable personally and he is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act 25 required or by reason of any act or omission in the discharge of his duties. Any suit brought against the Building Official or employee, because of 26 such act or omission performed by him in the enforcement of any provisions of this Code, shall be defended by the legal department of the 27 City until final termination of the proceedings. This Code is one of general application and nothing herein is intended to create liability or 28 cause action running in favor of individual members of the public. 20 80-9 UNSAFE CONDITIONS. All electrical wires, equipment and apparatus which are unsafe or not provided with adequate safeguards, or 30 which constitute a fire hazard, or are otherwise dangerous to human life, or which in relation to existing use constitute a hazard to safety or 31 health, or public welfare, by reason of inadequate maintenance, 32 2
