Any damage resulting from freezing shall be considered the <br /> 2 responsibility of the consumer and no adjustment shall be made in the water <br /> 3 billing by reason of the freezing and subsequent leakage. <br /> 4 Section 38: Right to Shut Off--Notice Not Required. <br /> 5 The Utilities Division shall have the right to shut off or turn on the <br /> 6 water from its mains and services at any time, without notice, for repairs, <br /> 7 construction, reconstruction, maintenance, operation and other purposes, <br /> 8 without liability for injury to persons or damage to property of its <br /> 9 customers and others. The Utilities Division will endeavor to notify <br /> 10 customers where practicable but shall not accept responsibility nor <br /> 11 liability for injury to persons or the safety of boilers, hot water tanks, <br /> 12 appliances or other property on the premises of any water consumer. <br /> 13 Section 39: Right to Impose Water Use Restrictions. <br /> 14 The Utilities Division shall have the right to forbid and/or establish <br /> 15 certain specified hours for lawn and garden sprinkling and other <br /> 16 nonessential uses of water within the whole or specified parts of the water <br /> 17 system when there is an actual or impending water shortage, extreme pressure <br /> 18 loss in the distribution system or for any other reasonable cause. The <br /> 19 Utilities Division may at any time determine such rules and/or restrictions <br /> 20 to be necessary and after reasonable notification thereof may enforce same. <br /> 21 Upon the violation of any such rule and/or restriction, the water may be <br /> 22 shut off to the premises of the violator without notice and shall not be <br /> 23 turned on again until the owner or occupant of the premises has agreed to <br /> 24 comply with the rules and/or restrictions and has paid to the Utilities <br /> 25 Division a penalty charge of twenty dollars or such charge as established by <br /> 26 Council ordinance or resolution. <br /> 27 Section 40: Meter Standard Size and Design. <br /> 28 All meters shall be of a standard size and design as approved by the <br /> Z9 Utilities Superintendent and each meter shall be separately examined, tested <br /> 30 and approved before it is installed. The Utilities Superintendent shall <br /> 31 determine the various sizes and types of meters which shall be used for <br /> 32 metered service connections to the water system. <br /> 14 <br />
