1 J. Issuance of Licenses. 2 1. After an investigation, the Clerk shall issue the applicable license or licenses authorized by this chapter if the Clerk 3 finds: 4 a. That the applicant complies with all of the require- ments of this chapter; and 5 b. That the applicant, his or her employee, agent, 6 partner, director, officer, stockholder or manager has not made any false, misleading or fraudulent state- 7 ment of fact in the application for a license, or in any report or record required to be filed with the 8 Clerk. 9 2. The license application shall be approved or disapproved within ten (10) working days from the date of filing a 10 completed application which complies with the requirements of this chapter, unless the applicant agrees to an extension 11 of the time period in writing. 12 In the event that the City denies a license, the City shall within the aforesaid ten (10) day period notify the applicant 13 of the denial and the reasons therefor. The denial shall be for a period of time not to exceed one (1) year. Should the 14 applicant disagree with the City's determination, he must file a notice of nonacceptance with the City Attorney's 15 Office within two (2) working days of receipt of the notification of denial. 16 The City shall, within five (5) working days following receipt 17 of the notice of nonacceptance, apply to the Snohomish County court for a judicial determination as to whether the 18 applicant's license was properly denied. The burden of showing that the applicant's license was properly denied 19 shall rest on the City. 20 If a preliminary judicial determination sustaining the City's denial of the subject license is not obtained within five (5) 21 working days from the date the complaint is served, an interim license shall be issued under this chapter by opera- 22 tion of the law. Said interim license shall issue in any event if a final judical determination on the mertis is not obtained 23 within twenty (20) days from the date the complaint is filed. In such case, the interim license will remain in effect until a 24 final judicial determination on the merits is reached. Provided, however, that any delays caused or requested by 25 the applicant shall be excluded from the above-mentioned 26 twenty (20) day period. 27 K. Suspension or Revocation of Licenses - Notice - Summary 28 Suspension or Revocation. The City Clerk may suspend or revoke any license issued 29 pursuant to this chapter for a period of time not to exceed one 30 year where one or more of the following conditions exist: 1.
