1 J. Issuance of Licenses. <br /> 2 1. After an investigation, the Clerk shall issue the applicable <br /> license or licenses authorized by this chapter if the Clerk <br /> 3 finds: <br /> 4 a. That the applicant complies with all of the require- <br /> ments of this chapter; and <br /> 5 <br /> b. That the applicant, his or her employee, agent, <br /> 6 partner, director, officer, stockholder or manager has <br /> not made any false, misleading or fraudulent state- <br /> 7 ment of fact in the application for a license, or in <br /> any report or record required to be filed with the <br /> 8 Clerk. <br /> 9 2. The license application shall be approved or disapproved <br /> within ten (10) working days from the date of filing a <br /> 10 completed application which complies with the requirements <br /> of this chapter, unless the applicant agrees to an extension <br /> 11 of the time period in writing. <br /> 12 In the event that the City denies a license, the City shall <br /> within the aforesaid ten (10) day period notify the applicant <br /> 13 of the denial and the reasons therefor. The denial shall be <br /> for a period of time not to exceed one (1) year. Should the <br /> 14 applicant disagree with the City's determination, he must <br /> file a notice of nonacceptance with the City Attorney's <br /> 15 Office within two (2) working days of receipt of the <br /> notification of denial. <br /> 16 <br /> The City shall, within five (5) working days following receipt <br /> 17 of the notice of nonacceptance, apply to the Snohomish <br /> County court for a judicial determination as to whether the <br /> 18 applicant's license was properly denied. The burden of <br /> showing that the applicant's license was properly denied <br /> 19 shall rest on the City. <br /> 20 If a preliminary judicial determination sustaining the City's <br /> denial of the subject license is not obtained within five (5) <br /> 21 working days from the date the complaint is served, an <br /> interim license shall be issued under this chapter by opera- <br /> 22 tion of the law. Said interim license shall issue in any event <br /> if a final judical determination on the mertis is not obtained <br /> 23 within twenty (20) days from the date the complaint is filed. <br /> In such case, the interim license will remain in effect until a <br /> 24 final judicial determination on the merits is reached. <br /> Provided, however, that any delays caused or requested by <br /> 25 the applicant shall be excluded from the above-mentioned <br /> 26 twenty (20) day period. <br /> 27 K. Suspension or Revocation of Licenses - Notice - Summary <br /> 28 Suspension or Revocation. <br /> The City Clerk may suspend or revoke any license issued <br /> 29 pursuant to this chapter for a period of time not to exceed one <br /> 30 year where one or more of the following conditions exist: <br /> 1. The license was procured by fraud or false representation of <br /> 31 fact in the application or in any report or record required to <br /> 32 be filed with the Clerk; <br /> -5- <br />
