If the City <br /> has reason to believe that collusion exists among Bidders, the City will reject the <br /> Bids of the known participants in such collusion and may, at its option, require that <br /> all Bidders certify under penalty of perjury, that no collusion has occurred or exists. <br /> 1-02.9 Delivery of Proposal <br /> Delete all of 1-02.9 and substitute the following: <br /> Bidder shall submit Bidder's Proposal in a sealed opaque envelope that clearly and <br /> legibly notes the Project Name, the time and date of the bid opening, and the Bidder's <br /> name and address on the outside of the envelope. <br /> The City will not open or consider any Proposal or any supplement to a Proposal that <br /> is received after the time specified for receipt of Proposals, or received in a location <br /> other than that specified for receipt of Proposals. 111 <br /> 1-02.10 Withdrawaling, Revising, or Supplementing Proposal <br /> Delete 1-02.10 and substitute with the following: I <br /> After submitting a physical Bid Proposal to the City, the Bidder may withdraw, revise, or <br /> supplement it if: <br /> 1. The Bidder submits a written request signed by an authorized person, and I <br /> 2. The City receives the request before the time set for receipt of Proposals. <br /> The original physical Bid Proposal may be supplemented, or revised and resubmitted <br /> as the official Bid Proposal if the City receives it before the time set for receipt of <br /> Proposals. Email, fax or telephone requests to withdraw, revise, or supplement a <br /> Proposal are not acceptable. <br /> Resubmitted Proposals shall be in full compliance with the bidding requirements. Bid I <br /> deposit shall be in an amount sufficient for the Proposal as resubmitted. <br /> After the scheduled time for opening Proposals, no Bidder will be permitted to withdraw <br /> his Proposal unless the award of contract is delayed for a period exceeding 45 <br /> calendar days. Proposals received after the scheduled closing for opening Proposals <br /> will be returned unopened to the Bidder. <br /> 1-02.12 Public Opening of Proposals I <br /> Supplement 1-02.12 by adding the following: <br /> 1-02.12(1) Postponement of Opening <br /> (******) <br /> The City reserves the right to postpone the date and time for receiving or opening of <br /> Bids, or both, at any time prior to the date and time established in the Notice to <br /> Bidders. Postponement notices shall be provided to Bidders in the form of addenda. <br /> 1-02.13 Irregular Proposals <br /> Revise item 1 of 1-02.13 to read as follows: <br /> 1. A Proposal will be considered irregular and will be rejected if: <br /> a. The Bidder is not prequalified when so required; <br /> b. The authorized proposal form furnished by the City is not used or is altered; <br /> c. The completed proposal form contains any unauthorized additions, deletions, <br /> alternate Bids, or conditions; <br /> d. The Bidder adds provisions reserving the right to reject or accept the Award, <br /> or enter into the Contract; <br /> e.
