1 in violation of this ordinance and that such violation must be corrected within thirty <br /> 2 (30) days of the date of such notice, and that in the event such violation continues <br /> 3 beyond thirty (30) days, the City may commence enforcement proceedings either by <br /> 4 filing an ordinance violation, or in the alternative, come on the property of the violator <br /> 5 and designate and sign the required fire lane. <br /> 6 Section 5: FAILURE TO COMPLY - LIEN ON PROPERTY. Any expense <br /> 7 reasonably incurred by the City of Everett as a result of the Fire Department carrying <br /> 8 out its duty imposed herein shall become a charge against the owner of the property and <br /> 9 a lien against the property. The Notice of Lien shall be substantially the same as <br /> 10 provided by law for liens for labor and materials in the State of Washington, and shall <br /> 11 be filed with the same officer within the same time and manner and enforced and <br /> 12 foreclosed as is provided by the laws of the State of Washington for liens for labor and <br /> 13 materials. Provided, the City must give notice as set forth in Section 5 herein to the <br /> 14 owner of said property whose name appears on the property tax rolls of the County <br /> 15 prior to commencing the work giving rise to the City's lien on the property. <br /> 16 Section 6: DUTY NOT TO OBSTRUCT FIRE LANE. <br /> 17 1. When signs are erected indicating fire lanes as authorized herein, the <br /> 18 required width shall not be obstructed or caused to be obstructed in any manner, <br /> 19 including parking or stopping of vehicles. <br /> 20 2. No person shall erect or cause to be allowed gates, chains or other <br /> 21 barriers, or security gates on fire lanes, unless approved by the Fire Chief or his <br /> 22 designee. When any locked gate, barrier or chain has been approved, the owner shall <br /> 23 supply a sufficient number of entry keys or keycards to the Fire Chief or his designee. <br /> 24 Section 7: ENFORCEMENT. When an infraction exists, the Everett Police <br /> 25 Department is authorized to cite and/or immediately impound any motor vehicle or <br /> 26 obstruction parked in a fire lane or within fifteen (15) feet of any fire hydrant whether <br /> 27 on public or private property. <br /> 28 Section 8: PENALTIES. Except as otherwise provided, any person who <br /> 29 violates the provisions of this ordinance shall be guilty of a misdemeanor and punished <br /> 30 by a fine not to exceed Three Hundred Fifty Dollars ($350). <br /> 31 <br /> 32 <br /> -3- <br />
