• <br /> 1 The Building Official shall keep a permanent, accurate account of all fees <br /> and other monies collected and received under this code, the names of the <br /> 2 persons upon whose account the same were paid, the date and amount <br /> thereof, together with the location of the building or premises to which <br /> 3 they relate. <br /> 4 80-6 RIGHT OF ENTRY. Whenever necessary to make an inspection <br /> to enforce any provision of this ordinance, the Building Official or his <br /> 5 authorized representative may enter any building or premises as pre- <br /> scribed in Ordinance No. 315-74 as it presently exists or is hereafter <br /> 6 amended. <br /> 7 80-7 STOP ORDERS. Whenever any work is being done contrary to <br /> the provisions of this ordinance, the Building Official may order the work <br /> 8 stopped by notice in writing served on any persons engaged in the doing or <br /> causing such work to be done and any such persons shall forthwith stop <br /> 9 such work until authorized by the Building Official to proceed with the <br /> work. <br /> 10 <br /> 80-8 LIABILITY. The Building Official or any employee charged with <br /> 11 the enforcement of this ordinance, acting in good faith and without <br /> malice for the City in the discharge of his duties, shall not thereby render <br /> 12 himself liable personally and he is hereby relieved from all personal <br /> liability for any damage that may accrue to persons or property as a <br /> 13 result of any act required or by reason of any act or omission in the <br /> discharge of his duties. Any suit brought against the Building Official or <br /> 14 employee, because of such act or omission performed by him in the <br /> enforcement of any provisions of this Code, shall be defended by the <br /> 15 Legal Department of the City until final termination of the proceedings. <br /> This ordinance is one of general application and nothing herein is intended <br /> 16 to create liability or cause or action running in favor of individual <br /> members of the public. <br /> 17 <br /> 80-9 UNSAFE CONDITIONS. All electrical wires, equipment and ap- <br /> 18 paratus which are unsafe or not provided with adequate safeguards, or <br /> which constitute a fire hazard, or are otherwise dangerous to human life, <br /> 19 or which in relation to existing use constitute a hazard to safety or <br /> health, or public welfare, by reason of inadequate maintenance, <br /> 20 obsolescense, fire hazard, disaster damage, or abandonment, as specified <br /> in this ordinance or any other effective ordinance, are, for the purpose of <br /> 21 this section, considered unsafe conditions. All such unsafe conditions are <br /> hereby declared to be public nuisances and the owner or his agent must <br /> 22 abate by repair, rehabilitation, demolition, or removal in accordance with <br /> this ordinance or by any other procedures provided by law. <br /> 23 80-10 BOARD OF APPEALS. In order to determine the suitability of <br /> 24 alternate materials and methods of construction and to provide for <br /> reasonable interpretation of the provisions of this Code, there shall be and <br /> 25 is hereby a Board of Appeals, as created by Ordinance No. 351-75 as it <br /> presently exists or is hereafter amended, to pass upon matters pertaining <br /> 26 to building construction. <br /> 27 80-11 VIOLATIONS AND PENALTIES. It shall be unlawful for any <br /> person, firm, or corporation to install, alter or extend any electrical <br /> 28 equipment in the City, or cause the same to be done, contrary to or in <br /> violation of any of the provisions of this Code. Any person, firm, or <br /> 29 corporation violating any of the provisions of this Code shall be deemed <br /> guilty of a misdemeanor, and each such person shall be deemed guilty of a <br /> 30 separate offense for each and every day or portion thereof during which <br /> any violation of any of the provisions of this Code is committed, <br /> 31 continued or permitted, and upon conviction of any such violation such <br /> person shall be punishable by a fine of not more than $500 or by <br /> 32 imprisonment for not more than 6 months, or by both fine and imprison- <br /> ment. <br /> -2- <br />
