6. EMC 19.33.250.D requires a minimum rear setback of three feet from the rear lot line for <br /> infill dwellings.The applicant proposed a rear setback of zero feet from the rear lot line for <br /> the proposed infill duplex. <br /> 7. EMC 19.33.120.B grants the Planning Director the authority to allow an applicant to deviate <br /> from certain development standards contained in the neighborhood conservation guidelines <br /> and Rucker Grand historic overlay zone standards after review and recommendation by the <br /> historical commission. <br /> 8. The Historical Commission reviewed the requests to convert the existing single family house <br /> to a six unit multi-family dwelling, and to construct a new rear yard infill duplex with <br /> deviations from the rear setback and roof pitch on November 21,2016. <br /> 9. The Historical Commission, in considering the requests in accordance with EMC 19.33.120 <br /> and 19.33.130,recommended approval for conversion of the existing single family dwelling <br /> to a six unit multi-family structure;recommended approval for the construction of a rear yard <br /> full duplex;recommended approval for either a shed or hip roof with deviations from the <br /> six to twelve vertical to horizontal ratio roof slope requirement for the proposed infill duplex; <br /> and recommended approval of a rear setback of zero feet from the rear lot line for the <br /> proposed infill duplex. <br /> CONCLUSIONS OF LAW: <br /> Authority: The Planning Director of the City of Everett has authority to issue this Review <br /> Process II decision. That authority is set forth in EMC 15.16.070. Based on the above Findings <br /> of Fact, the Planning Director enters the following conclusions: <br /> CONCLUSIONS BASED ON FINDINGS: <br /> 1. Conversion of the existing single family dwelling to a six unit multi-family structure is a <br /> permitted use. (findings 2 and 3) <br /> 2. Construction of a rear yard infill duplex is a permitted use. findings 2 and 4) <br /> 3. Deviation from the minimum roof slope requirement of six to twelve vertical to horizontal <br /> ratio for the rear yard infill duplex is permitted. (finding 7) <br /> 4. Deviation from the minimum rear setback requirement of three feet for the rear yard infill <br /> duplex is permitted. (finding 7) <br /> DECISION: <br /> Based upon the preceding Findings of Fact and Conclusions of Law, and for the reasons as set <br /> forth in the Conclusions of Law of this document,the Planning Director approves the requests of <br /> Rucker II,LLC to convert the existing single family dwelling located at 2108 Rucker Aven - <br /> Planning Director Decision Page 2 of 7 <br /> IIC 16-001 <br />
