replaced"in-kind"with young or immature plants of the same
type, unless otherwise indicated. These plants will be smaller than
the original plant in most cases.
Restoration of on-site utilities (including irrigation and electrical
systems),paver patios and walkways, and other landscape features
will be performed using existing materials at the Property and will
be restored to the same state that they are in at the beginning of the
project.. Ecology will inform City representatives if existing
materials re-used in the restoration are in poor condition, if
discovered after the bid,but replacement of such materials shall
not be Ecology's responsibility. The City should provide materials
as needed to Ecology for integration during work prior to the start
of work. If the contractor damages the utilities, it is responsible for
their repair in a timely manner.
10. Notifying the City when Ecology's Work has been completed.
11. Providing documentation to the Owner of all Work performed for
the Property. This documentation shall be provided as part of the
overall clean-up notebook provided by Ecology to the Owner one
(1)year of the completion of the Work, as practicable.
(9) Ecology Investigation of Reported Issues
Ecology will use the following procedure for investigating concerns and
issues reported by the City during the performance period of this Owner
Agreement. Ecology will endeavor to provide the City a response to
reported issues within 48 hours of their discovery or reporting by the City.
Ecology, may modify this procedure to more specifically address the
reported concerns and/or issues:
1. An Ecology representative will respond to contacts from the City
by the next business day after the report is communicated to
Ecology or Ecology's field representatives. Weekends and State
legal holidays will typically delay an initial response until the next
business day after the weekend or holiday unless the report is of a
nature that is deemed to be an emergency. This response may
involve scheduling a time to meet with the City to discuss their
concerns and/or scheduling a time when an Ecology field
representative can visit the Property and investigate the reported
issue.
2. Information on the reported issue will be obtained through a
condition-appropriate combination of examining the visible
Owner Initials: CO
7
