1 <br /> responsibility of the Contractor to determine the exact location of utilities and service <br /> connections thereto. Such field verification must be performed in sufficient time so as <br /> not to impede the progress of the Work or fabrication of materials to be incorporated <br /> into the Work. The Contractor shall call the Utility Location Request Center (one call <br /> center) for location of utilities in the field not less than two nor more than ten business <br /> days before the scheduled date of commencement of excavation. The Contractor shall <br /> make its own investigations, including exploratory excavations, to determine the <br /> locations and type of existing utilities, including service connections, prior to <br /> commencing work that could result in damage to such utilities. The Contractor shall <br /> immediately notify the Owner's Representative as to any utility discovered by him in a <br /> different position than shown on the Drawings or which is not shown on the Drawings. <br /> No excavation shall begin until all known facilities in the excavation areas have been <br /> marked. Contractor shall coordinate its activities with the utility provider. Contractor <br /> shall bear the cost of maintaining utility service. <br /> b. The Contractor should be aware of, and comply with, Chapter 19.122 RCW, a law <br /> relating to underground utilities. The Owner shall not pay Contractor any of <br /> Contractor's cost of complying with this law, and repairing or indemnifying any <br /> damage or injury arising out of Contractor's failure to comply with this law. <br /> c. Owner does not represent or warrant who may be obligated to pay for the cost of <br /> relocation or temporary maintenance of the utility. Contractor shall investigate whether <br /> such cost must be borne by the owner of the utility. <br /> d. Governmental agencies and owners of utilities reserve the right to enter upon streets, <br /> alleys, rights-of-way, or easements for the purpose of making changes in their property <br /> made necessary by the Work and for the purpose of maintaining and making repairs to <br /> their property. <br /> 2. Known Utilities <br /> a. The Contractor shall provide at its sole expense all labor, equipment, materials and <br /> services necessary to remove, relocate, or maintain utilities specified on the Drawings. <br /> The work on each utility shall be performed in a manner satisfactory to the utility <br /> owner. The utility owner has the option of doing such work with its own forces at the <br /> Contractor's expense, or permitting the work to be performed by the Contractor. <br /> 3. Service Connections <br /> a. Locations of service connections are not identified on the Drawings. The Contractor <br /> shall provide at its sole expense all labor, equipment and material to remove, relocate or <br /> maintain service connections. Work on service connections shall be performed in a <br /> manner satisfactory to the service connection owner. The service connection owner has <br /> the option of doing such work with its own force at the Contractor's expense, or <br /> permitting the work to be performed by the Contractor. ' <br /> 4. Unknown Utilities <br /> a. When a utility interferes with the Work and is either(1)not identified on the Drawings <br /> or (2) located in a position significantly different from that specified on the Drawings, <br /> Contractor shall follow the procedures of ARTICLE 11. DIFFERING SITE <br /> CONDITIONS. Interference with the Work is defined as a utility that crosses or <br /> projects into the plane of the Work at an elevation between the top and bottom of the <br /> Work. If it is necessary to remove, relocate, or temporarily maintain the utility, that <br /> work shall be included in a Change Order. The utility owner has the option of doing <br /> such work or permitting the work to be performed by the Contractor.
