We further request that this <br /> grandfathering or other form of exemption be carried forward into the soon to-be- <br /> adopted Metro Subarea Plan. The purpose and intent of both requests is to enable Ideal <br /> Option to best serve a community in need by operating its business at 2808 Hoyt Avenue <br /> pursuant to its lease which predates both the adoption and effective date of the <br /> moratorium and forthcoming subarea plan. Ideal Option's leased clinic space is located <br /> in the B-3 zone. Its clinic replaces another clinic which has relocated to outside the B-3 <br /> zone. Thus, Ideal Option's operation will not increase the number of medical facilities <br /> located within the restricted zone. <br /> This process of relocating to 2808 Hoyt began prior to Ordinance 3598-18 being enacted. <br /> The lease for the clinic premises was executed on March 5, 2018. The subject moratorium <br /> was adopted two days later,on March 7. The moratorium did not become effective until <br /> April 1. Ideal Option would prefer that clinics be allowed outright in the B-3 zone. Failing <br /> that,by either recognizing Ideal Option's"grandfathered" status or exempting it because <br /> it is replacing a prior operating clinic, Ideal Option will be able to continue to render <br /> needed medical assistance and access to patients suffering from debilitating opiate use <br /> disorder.
