1 thereof, together with the location of the building or premises to which <br /> they relate. <br /> 2 <br /> 80-6 RIGHT OF ENTRY. Whenever necessary to make an inspection to <br /> 3 enforce any provision of this ordinance, the Building Official or his <br /> authorized representative may enter any building or premises as <br /> 4 prescribed in Ordinance No. 315-74. <br /> 5 80-7 STOP ORDERS. Whenever any work is being done contrary to the <br /> provisions of this ordinance, the Building Official may order the work <br /> 6 stopped by notice in writing served on any persons engaged in the doing or <br /> causing such work to be done and any such persons forthwith stop such <br /> 7 work until authorized by the Building Official to proceed with the work. <br /> 8 80-8 LIABILITY. The Building Official or any employee charged with <br /> the enforcement of this ordinance, acting in good faith and without malice <br /> 9 for the City in the discharge of his duties, shall not thereby render himself <br /> liable personally and he is hereby relieved from all personal liability for <br /> 10 any damage that may accrue to persons or property as a result of any act <br /> required or by reason of any act or omission in the discharge of his duties. <br /> 11 Any suit brought against the Building Official or employee, because of <br /> such act or omission performed by him in the enforcement of any <br /> 12 provisions of this Code, shall be defended by the legal department of the <br /> City until final termination of the proceedings. This ordinance is one of <br /> 13 general application and nothing herein is intended to create liability or <br /> cause action running in favor of individual members of the public. <br /> 14 <br /> 80-9 UNSAFE CONDITIONS. All electrical wires, equipment and <br /> 15 apparatus which are unsafe or not provided with adequate safeguards, of <br /> which constitute a fire hazard, or are otherwise dangerous to human life, <br /> 16 or which in relation to existing use constitute a hazard to safety or health, <br /> or public welfare, by reason of inadequate maintenance, obsolescense, fire <br /> 17 hazard, disaster damage, or abandonment, as specified in this ordinance or <br /> any other effective ordinance, are, for the purpose of this section, <br /> 18 considered unsafe conditions. All such unsafe conditions are hereby <br /> declared to be public nuisances and the owner or his agent must abate by <br /> 19 repair, rehabilitation, demolition, or removal in accordance with this <br /> ordinance or by any other procedures provided by law. <br /> 20 80-10 BOARD OF APPEALS. In order to determine the suitability of <br /> 21 alternate materials and methods of construction and to provide for <br /> reasonable interpretation of the provisions of this Code, there shall be and <br /> 22 is hereby a Board of Appeals, as created by Ordinance No. 351-75, to pass <br /> upon matters pertaining to building construction. <br /> 23 80-11 VIOLATIONS AND PENALTIES. It shall be unlawful for any <br /> 24 person, firm, or corporation to install, alter, or extend any electrical <br /> equipment in the City, or cause the same to be done, contrary to or in <br /> 25 violation of any of the provisions of this Code. Any person, firm, or <br /> corporation violating any of the provisions of this Code shall be deemed <br /> 26 guilty of a misdemeanor, and each such person shall be deemed guilty of a <br /> separate offense for each and every day or portion thereof during which <br /> 27 any violation of any of the provisions of this Code is committed, continued <br /> or permitted, and upon conviction of any such violation such person shall <br /> 28 be punishable by a fine of not more than $500 or by imprisonment for not <br /> more than 6 months, or by both such fine and imprisonment. <br /> 29 80-12 PERMITS AND INSPECTIONS. <br /> 30 (a) Permits required. No person, firm or corporation shall install, <br /> 31 alter, replace, or extend any electrical work or equipment except <br /> 32 -18- <br />
