1 Section 10: Section 202(c) of the 1979 Uniform Building Code is hereby <br /> 2 amended by deleting: <br /> - 3 <br /> (c) Right of Entry. Whenever necessary to make an inspection <br /> 4 to enforce any of the provisions of this code, or whenever the building <br /> official or his authorized representative has reasonable cause to believe <br /> 5 that there exists in any building or upon any premises any condition or <br /> code violation which makes such building or premises unsafe, dangerous or <br /> 6 hazardous, the building official or his authorized representative may enter <br /> such building or premises at all reasonable times to inspect the same or to <br /> 7 perform any duty imposed upon the building official by this code, provided <br /> that if such building or premises be occupied, he shall first present proper <br /> 8 credentials and request entry; and if such building or premises be <br /> unoccupied, he shall first make a reasonable effort to locate the owner or <br /> 9 other persons having charge or control of the building or premises and <br /> request entry. If such entry is refused, the building official or his <br /> 10 authorized representative shall have recourse to every remedy provided by <br /> law to secure entry. <br /> 11 When the building official or his authorized representative shall <br /> have first obtained a proper inspection warrant or other remedy provided <br /> 12 by law to secure entry, no owner or occupant or any other persons having <br /> charge, care or control of any building or premises shall fail or neglect, <br /> 13 after proper request is made as herein provided, to promptly permit entry <br /> therein by the building official or his authorized representative for the <br /> 14 purpose of inspection and examination pursuant to this code. <br /> 15 <br /> and inserting in its place: <br /> 16 <br /> 17 Whenever necessary to make an inspection to enforce any provision of this <br /> ordinance, the Building Official or his authorized representative may <br /> 18 enter any building or premises as prescribed in Ordinance No. 315-74, <br /> Chapter 1.12 EMC. <br /> 19 <br /> 20 Section 11: Section 204 of the Uniform Building Code is hereby amended by <br /> 21 deleting: <br /> 22 In order to determine the suitability of alternate materials and methods of <br /> 23 construction and to provide for reasonable interpretations of the <br /> provisions of this code, there shall be and is hereby created a Board of <br /> 24 Appeals, consisting of five members who are qualified by experience and <br /> training to pass upon matters pertaining to building construction. The <br /> 25 Building Official shall be an ex officio member and shall act as Secretary <br /> of the Board. The Board of Appeals shall be appointed by the Governing <br /> 26 Body and shall hold office at its pleasure. The Board shall adopt <br /> reasonable rules and regulations for conducting its investigations and shall <br /> 27 render all decisions and findings in writing to the Building Official with a <br /> duplicate copy to the appellant and may recommend to the Governing <br /> 28 Body such new legislation as is consistent therewith. <br /> 29 and inserting in its place: <br /> 30 <br /> 31 <br /> 32 -3- <br />
