1 Section 10: Section 202(c) of the 1979 Uniform Building Code is hereby 2 amended by deleting: - 3 (c) Right of Entry. Whenever necessary to make an inspection 4 to enforce any of the provisions of this code, or whenever the building official or his authorized representative has reasonable cause to believe 5 that there exists in any building or upon any premises any condition or code violation which makes such building or premises unsafe, dangerous or 6 hazardous, the building official or his authorized representative may enter such building or premises at all reasonable times to inspect the same or to 7 perform any duty imposed upon the building official by this code, provided that if such building or premises be occupied, he shall first present proper 8 credentials and request entry; and if such building or premises be unoccupied, he shall first make a reasonable effort to locate the owner or 9 other persons having charge or control of the building or premises and request entry. If such entry is refused, the building official or his 10 authorized representative shall have recourse to every remedy provided by law to secure entry. 11 When the building official or his authorized representative shall have first obtained a proper inspection warrant or other remedy provided 12 by law to secure entry, no owner or occupant or any other persons having charge, care or control of any building or premises shall fail or neglect, 13 after proper request is made as herein provided, to promptly permit entry therein by the building official or his authorized representative for the 14 purpose of inspection and examination pursuant to this code. 15 and inserting in its place: 16 17 Whenever necessary to make an inspection to enforce any provision of this ordinance, the Building Official or his authorized representative may 18 enter any building or premises as prescribed in Ordinance No. 315-74, Chapter 1.12 EMC. 19 20 Section 11: Section 204 of the Uniform Building Code is hereby amended by 21 deleting: 22 In order to determine the suitability of alternate materials and methods of 23 construction and to provide for reasonable interpretations of the provisions of this code, there shall be and is hereby created a Board of 24 Appeals, consisting of five members who are qualified by experience and training to pass upon matters pertaining to building construction. The 25 Building Official shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the Governing 26 Body and shall hold office at its pleasure. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall 27 render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant and may recommend to the Governing 28 Body such new legislation as is consistent therewith. 29 and inserting in its place: 30 31 32 -3-
