J. Shorelines of Everett are the total of all "Shorelines" and "Shorelines <br /> of State-Wide Significance" within the City. <br /> K. Substantial Development means any development of which the total cost <br /> of fair market value exceeds $1,000, or any development having an inter- <br /> related effect on both uplands and "Shorelines of Everett", or any develop- <br /> ment which materially interferes with normal public use of the water <br /> or shorelines of Everett. <br /> L. Substantial Progress towards construction shall include, but not be limited <br /> to the letting of bids, making of contracts, purchase of material involved <br /> in development, but shall not include development or uses which are in- <br /> 1 e_- <br /> consistent with the criteria set forth in Section 1944440, provided, that <br /> in determining the running of the two-year period, there shall not be included <br /> the time during which a development was not actually pursued by construction <br /> and the pendency of litigation reasonably related there to make it reasonable <br /> not to so pursue. <br /> M. Wetlands or Wetland Areas means those lands extending landward for <br /> at least 200 feet in all directions, as measured on a horizontal plane from <br /> the ordinary high-water mark of Silver Lake, Port Gardner Bay, and the <br /> Snohomish River, and all marshes, swamps, floodways, river deltas, and <br /> flood plains associated with the above areas. The wetland area shall not <br /> be greater than the 100-year flood plain boundary as established by Everett's <br /> Flood Insurance Study per HUD Guidelines. <br /> Section 4: PERMIT EXEMPTIONS: <br /> The following shall not be required to obtain "substantial development" permits. <br /> A. Development which does not exceed $1,000, if such development does <br /> not materially interfere with the normal public use of the water or "shore- <br /> line of the City"; <br /> B. Normal maintenance or the repair of existing structures or developments, <br /> including damage by accident, fire or elements; <br /> C. Construction of the normal protective bulkhead common to single-family <br /> residences (i.e. Silver Lake); <br /> D. Emergency construction necessary to protect property from damage by <br /> the elements; <br /> -3- <br />
