d. Time and Date, and Process To Be Used in Making the Decision <br /> on the Permit. <br /> e. Deadline for Comments. <br /> f. Status of Project Relative to Ordinance /1582-79. (Environmental <br /> Review) <br /> g. A statement that any person may submit oral or written comments <br /> on an application whether it is processed administratively <br /> or by public hearing. <br /> Section 10: PUBLIC HEARING REVIEW PROCESS: <br /> A. In the following cases, decision on applications for "Shoreline permits" <br /> shall not be made until one public hearing has been held: <br /> 1. The Planning Commission shall hold a hearing on projects exceeding <br /> five (5) acres in size. <br /> 2. The Hearing Examiner shall hold a hearing on projects between <br /> one (1) acre and five (5) acres in size. <br /> 3. Projects involving a conditional use or variance shall have a public <br /> hearing per sections 10.A.1 and 2 of this Ordinance. <br /> 4. The project has been administratively denied by the Planning Director. <br /> B. When a public hearing is required, the Planning Department shall prepare <br /> a recommendation for the Planning Commission or Hearing Examiner by <br /> evaluating the proposal utilizing the criteria in Section 7 of this Ord. The <br /> Planning Commission or Hearing Examiner shall make its decision based on <br /> the recommendation, public comments received, the information presented <br /> by the applicant, and the criteria in Section 7 of this Ordinance. <br /> C. The Planning Commission or Hearing Examiner recommendation shall be <br /> conveyed to City Council for its consideration at a regular public meeting. <br /> D. City Council shall take final action on all shoreline permits requiring <br /> a public hearing. <br /> Section 11: ADMINISTRATIVE ISSUANCE OF PERMIT: <br /> A. An application for "Shoreline permit" may be approved by the Planning <br /> Director provided: <br /> 1. The project does not require a public hearing per Section 10, and; <br /> 2. The project is clearly incidental and accessory to the primary activity <br /> presently occurring on the subject property; and <br /> -7- <br />
