3. The project is consistent with Everett's Shoreline "Master Program", <br /> and the Shoreline Act of 1971. <br /> 4. The project is identified as having an insignificant impact on the <br /> environment. <br /> 5. Any decision to grant or deny the issuance of a "shoreline permit" <br /> by Planning Director may be appealled to the Hearing Examiner <br /> by either the applicant or other aggrieved party, and shall be heard <br /> by the Hearing Examiner. <br /> Section 12: GRANTING OR DENIAL OF SHORELINE PERMITS; CONDITIONS <br /> ATTACHED TO SHORELINE PERMITS; OTHER PERMITS: <br /> A. The City shall provide copies of the action taken on an application for <br /> a "Shoreline permit" to the following, within seven days of the final lo- <br /> cation decision: <br /> 1. The applicant; <br /> 2. The Department of Ecology; <br /> 3. Washington State Attorney General; <br /> 4. Any person who has written requesting notification; <br /> 5. Any person who has written requesting a public hearing. <br /> B. Development pursuant to the issuance of a "Shoreline permit" shall not <br /> begin and shall not be authorized until thirty (30) days from the date the <br /> Department of Ecology receives the permit, or until all review proceed- <br /> ings, initiated within thirty (30) days from the date of such filing, have <br /> been terminated. <br /> C. In granting or extending a permit, the Planning Director, Planning <br /> Commission or Hearing Examiner may attach conditions, or modifications <br /> and restrictions regarding the location, character or other features of <br /> the proposed development as is necessary to make the permit compatible <br /> with the criteria set forth in Section 7. <br /> D. Issuance of a "Shoreline permit" does not exempt the applicant from meeting <br /> requirements for other federal, state, county and city permits, procedures <br /> and regulations. <br /> Section 13: FORMAT FOR "SHORELINE PERMITS": <br /> Permit format shall be substantially as described in WAC 173-14-120. <br /> Section 14: TIME REQUIREMENTS OF SHORELINE PERMITS: <br /> The following time requirements shall apply to all "Shoreline permits", including <br /> -8- <br />
