On May 10,2010, Code Officer Fagerstrom issued a violation citation to the <br /> Respondent for violations of the International Residential Code 2006, 105.1 and <br /> the EMC 8.20.020, Rubbish Code and EMC 8.22.020(G)Junk Vehicle Code. The <br /> Citation was mailed to the Respondent via first-class and registered mail and a <br /> copy was posted at the Property. (Exhibit#3, violation citation dated May 10, <br /> 2010) (Exhibit#4, Declaration of Service with photo dated May 10, 2010) <br /> CONCLUSIONS OF LAW <br /> Based upon the above findings,the Examiner makes the following conclusions of law: <br /> 1. International Residential Code 2006,Section 105.1 states; <br /> Any owner or authorized agent who intends to construct, enlarge, alter, <br /> repair, move, demolish or change the occupancy of a building or <br /> structure, or to erect, install, enlarge, alter, repair, remove, convert or <br /> replace any electrical, gas, mechanical or plumbing system, the <br /> installation of which is regulated by this code, or cause any such work to <br /> be done, shall first make application to the building official and obtain the <br /> required permit. <br /> 2. Everett Municipal Code 8.20.020 states (in relevant part); <br /> No person owning, leasing, renting, occupying or having charge or <br /> possession of any property in the city, including vacant lots, shall maintain <br /> or allow to be maintained on such property except as allowed by any other <br /> city ordinance, any of the following conditions visible from any public <br /> street, alley or other public or private property: <br /> A. Junk, trash, litter, boxes, discarded lumber or other salvage materials in <br /> any front yard, side yard, rear yard or vacant lot. <br /> G. Vehicle parts or other articles of personal property which are discarded <br /> or left in a state of partial construction or repair in any front yard, side <br /> yard, rear yard or vacant lot. <br /> 3.
