• <br /> • <br /> • <br /> • <br /> • <br /> • <br /> 1 animal, or the offering of any service for gain in connection with such <br /> facility, shall require a license in accordance with procedures, standards and <br /> 2 limitations provided in this chapter; and no such facility may lawfully <br /> operate except upon application and payment of prescribed fees for such <br /> 3 license; issuance of such license shall not constitute approval of the land use <br /> nor evidence compliance with any zoning regulations which may apply to the <br /> 4 proposed facility operation. <br /> 5 Exception: <br /> A. Licensed Veterinary Hospitals and Clinics will not require a <br /> 6 facilities license. <br /> 7 B. Visiting animal exhibitions in the City Limits for 15 days or <br /> less must conform to facility standards, but are exempt from <br /> 8 normal license fees. <br /> 9 Section 2. Pre-existing Non-conforming Rights Preserved <br /> 10 Notwithstanding requirements of this chapter concerning licensing of certain <br /> facilities, persons who, upon the enactment date of this ordinance, legally <br /> 11 own, possess, harbor or house more than the allowable number of dogs and <br /> cats or combination thereof, shall be exempt from the licensing <br /> 12 requirements of this chapter, provided that the following conditions are met: <br /> 13 A. All dogs be individually licensed as of the enactment date of <br /> this ordinance. <br /> 14 <br /> B. Premises at which such dogs or cats are kept be inspected to <br /> 15 determine that housing and care facilities for such number of <br /> animals are sufficiently provided; however, that if inspection <br /> 16 determines the facilities to be insufficient, the owner shall <br /> agree to construct or otherwise provide sufficient facilities <br /> 17 within the time period established by the inspecting officer. <br /> 18 C. Owner must claim the exemption by notice to Animal Control <br /> within sixty (60) days of the enactment date of this ordinance. <br /> 19 <br /> D. Acquisition of additional animals by claiming owner after <br /> 20 enactment date of this ordinance shall extinguish any claim of <br /> right to an exemption from facilities licensing. <br /> 21 <br /> E. Exemption from facilities licensing requirement of this <br /> 22 ordinance shall be valid only during the lives of those animals <br /> owned upon enactment of this ordinance. <br /> 23 <br /> Section 3. Licensing Procedure <br /> 24 <br /> A. Application for a facilities license shall be made upon forms <br /> 25 furnished by Animal Control including all information required <br /> therein and shall be accompanied by payment of the required <br /> 26 fee (see Chapter VIII). <br /> 27 B. An initial license shall expire on the first day of the calendar <br /> year following issuance, and the fee therefore shall be subject <br /> 28 to quarterly proration. <br /> 29 C. During the initial year of this ordinance, persons filing <br /> application and paying the required fee for such license shall <br /> 30 be issued a receipt by the Director which shall constitute <br /> preliminary approval to operate such facility, subject to <br /> 31 inspection of the facility by the Director and final approval for <br /> operation. <br /> 32 <br />
