• • • • • • 1 animal, or the offering of any service for gain in connection with such facility, shall require a license in accordance with procedures, standards and 2 limitations provided in this chapter; and no such facility may lawfully operate except upon application and payment of prescribed fees for such 3 license; issuance of such license shall not constitute approval of the land use nor evidence compliance with any zoning regulations which may apply to the 4 proposed facility operation. 5 Exception: A. Licensed Veterinary Hospitals and Clinics will not require a 6 facilities license. 7 B. Visiting animal exhibitions in the City Limits for 15 days or less must conform to facility standards, but are exempt from 8 normal license fees. 9 Section 2. Pre-existing Non-conforming Rights Preserved 10 Notwithstanding requirements of this chapter concerning licensing of certain facilities, persons who, upon the enactment date of this ordinance, legally 11 own, possess, harbor or house more than the allowable number of dogs and cats or combination thereof, shall be exempt from the licensing 12 requirements of this chapter, provided that the following conditions are met: 13 A. All dogs be individually licensed as of the enactment date of this ordinance. 14 B. Premises at which such dogs or cats are kept be inspected to 15 determine that housing and care facilities for such number of animals are sufficiently provided; however, that if inspection 16 determines the facilities to be insufficient, the owner shall agree to construct or otherwise provide sufficient facilities 17 within the time period established by the inspecting officer. 18 C. Owner must claim the exemption by notice to Animal Control within sixty (60) days of the enactment date of this ordinance. 19 D. Acquisition of additional animals by claiming owner after 20 enactment date of this ordinance shall extinguish any claim of right to an exemption from facilities licensing. 21 E. Exemption from facilities licensing requirement of this 22 ordinance shall be valid only during the lives of those animals owned upon enactment of this ordinance. 23 Section 3. Licensing Procedure 24 A. Application for a facilities license shall be made upon forms 25 furnished by Animal Control including all information required therein and shall be accompanied by payment of the required 26 fee (see Chapter VIII). 27 B. An initial license shall expire on the first day of the calendar year following issuance, and the fee therefore shall be subject 28 to quarterly proration. 29 C. During the initial year of this ordinance, persons filing application and paying the required fee for such license shall 30 be issued a receipt by the Director which shall constitute preliminary approval to operate such facility, subject to 31 inspection of the facility by the Director and final approval for operation. 32
