• <br /> • <br /> C. Consultant Selection for Draft EIS Information <br /> 1. The Responsible Official shall maintain a list of consultants <br /> qualified to prepare environmental impact statements. <br /> 2. Any applicant required to submit data for the Draft EIS shall <br /> be deemed to have fulfilled the requirements of this Ordinance <br /> by utilizing the services of a consultant included upon the <br /> responsible consultants' list, PROVIDED, that the Responsible <br /> Official delay distribution of the Draft EIS, when necessary, <br /> to correct any deficiencies in the data submitted, and that <br /> the consultant shall provide such information as is required <br /> under Section 10A of this Ordinance. <br /> 3. All fees and charges for said consultant shall be the responsibility <br /> of the applicant. <br /> 4. The Responsible Official shall accept for inclusion upon the <br /> responsible consultant list any person, firm, corporation, <br /> partnership or association which: <br /> a. Documents its expertise in engineering, planning, biology, <br /> zoology, geology, and other areas of analysis under WAC 197- <br /> 10-444. <br /> b. Where the firm has had previous experience, provides one <br /> or more recommendations from the lead agency involved <br /> in the prior experiences. <br /> 5. The Responsible Officials may, upon notification to an affected <br /> firm remove said firm from the consultants' list for good <br /> cause including incompetence, misrepresentation, insufficiency, <br /> bias, or gross failure to perform in accordance with this <br /> Ordinance. The firm shall have the opportunity to present <br /> arguments to the Responsible Official prior to the Responsible <br /> Officials' actions and may request a finding and determination <br /> in writing for the purpose of review. The firm may apply <br /> for reinstatement to the consultants' list after one year <br /> and shall be reinstated upon approval by the Responsible Official. <br /> D. Consultant/Applicant Responsibilities <br /> When a private applicant or consultant prepares a Draft EIS, the <br /> following responsibilities are hereby specified: <br /> 1. City communicates and meets with the developer. <br /> 2. City communicates and meets with the consultant. <br /> 3. Consultant submits information in the form of a Draft EIS. <br /> 4. City reviews the Draft EIS. <br /> 5. City prepares review comments for Draft EIS changes. <br /> 6. Consultant prepares rough draft of EIS. <br /> 7. City and consultant review rough draft of EIS. <br /> 8. Consultant types, binds and prints draft EIS in sufficient <br /> quantity to satisfy WAC 197-10-460. The specific number shall <br /> be determined by the Responsible Official. <br /> -16- <br />
