• Section 14. - SEPA Public Information Center ;SEPA documents required by WAC 197-10 shall be retained by the Responsible Official and made available in accordance with Chapter 42.17RCW. Section 15. - Fees for Actions Relating to Private Projects: The following fees shall be required for actions by the City in accordance with the provisions of this Ordinance: A. Initial Review: 1. For a preliminary determination, as defined in Section 6(a) of this Ordinance: No fee. 2. For a threshold determination based upon review of an Environmental Checklist: A fee of $50.00 payable upon the filing of the Environmental Checklist. 3. For the review and issuance of a Draft and Final EIS in conformance with other provisions of this Ordinance: A fee of $250.00 payable upon the submittal of a preliminary draft EIS. Additional costs, if any, incurred by the City, shall be billed directly to the applicant; no additional costs may be charged for existing studies or general information already in the possession of the City; and provided that in no event shall the cost for an EIS review exceed $2,000. No fee shall be required under this section for proposals primarily involving the construction of publicly subsidized housing. 4. In the event that a proposal is modified so that an EIS is no longer required, the responsible official shall refund any costs collected under Section 3 above, which were collected for costs not incurred. B. The full fee for a threshold determination and/or an EIS shall be paid by the private applicant prior to the circulation of an EIS by the City. C. No fee shall be collected by the City for performing its duties as a consulted agency. Section 16. - Substantive Authority to Deny or Condition an Action The City possesses, and may exercise where appropriate, the authority to deny or condition any action as defined in WAC 197-10-040 (2) so as to mitigate or prevent adverse environmental impacts. Section 17. - Preparation of a Document Denying or Conditioning an Action The Responsible Official shall be required to prepare a written action denial document specifying adverse environmental impacts identified in the environmental documents prepared pursuant to Environmental Checklist Procedures (WAC 197-10- 320, -330, and -340) and Environmental Impact Statement Procedures (WAC 197- 10-440 through -695) when such adverse impacts provide a basis for the denial or conditioning of said action. -18-
