• <br /> Section 14. - SEPA Public Information Center <br /> ;SEPA documents required by WAC 197-10 shall be retained by the Responsible <br /> Official and made available in accordance with Chapter 42.17RCW. <br /> Section 15. - Fees for Actions Relating to Private Projects: <br /> The following fees shall be required for actions by the City in accordance <br /> with the provisions of this Ordinance: <br /> A. Initial Review: <br /> 1. For a preliminary determination, as defined in Section 6(a) of this <br /> Ordinance: No fee. <br /> 2. For a threshold determination based upon review of an Environmental <br /> Checklist: A fee of $50.00 payable upon the filing of the <br /> Environmental Checklist. <br /> 3. For the review and issuance of a Draft and Final EIS in conformance <br /> with other provisions of this Ordinance: A fee of $250.00 payable <br /> upon the submittal of a preliminary draft EIS. Additional costs, <br /> if any, incurred by the City, shall be billed directly to the <br /> applicant; no additional costs may be charged for existing studies <br /> or general information already in the possession of the City; and <br /> provided that in no event shall the cost for an EIS review exceed <br /> $2,000. No fee shall be required under this section for proposals <br /> primarily involving the construction of publicly subsidized housing. <br /> 4. In the event that a proposal is modified so that an EIS is no longer <br /> required, the responsible official shall refund any costs collected <br /> under Section 3 above, which were collected for costs not incurred. <br /> B. The full fee for a threshold determination and/or an EIS shall be paid <br /> by the private applicant prior to the circulation of an EIS by <br /> the City. <br /> C. No fee shall be collected by the City for performing its duties <br /> as a consulted agency. <br /> Section 16. - Substantive Authority to Deny or Condition an Action <br /> The City possesses, and may exercise where appropriate, the authority to deny <br /> or condition any action as defined in WAC 197-10-040 (2) so as to mitigate <br /> or prevent adverse environmental impacts. <br /> Section 17. - Preparation of a Document Denying or Conditioning an Action <br /> The Responsible Official shall be required to prepare a written action denial <br /> document specifying adverse environmental impacts identified in the environmental <br /> documents prepared pursuant to Environmental Checklist Procedures (WAC 197-10- <br /> 320, -330, and -340) and Environmental Impact Statement Procedures (WAC 197- <br /> 10-440 through -695) when such adverse impacts provide a basis for the denial <br /> or conditioning of said action. <br /> -18- <br />
