1 requirements set forth in Section 15. The "Class A" rating may be withdrawn from any <br /> 2 licensee not meeting such requirements. <br /> 3 2. (a) The list of qualified "Class A" licensed towing businesses shall be used in <br /> 4 connection with the impounding or removal of disabled or abandoned vehicles or <br /> 5 vehicles which may be impounded under provisions of law by order of the police and <br /> 6 pursuant to the provisions of Section 16. <br /> 7 (b) When a person makes a request to the Police Department or police <br /> 8 dispatcher for towing services when the vehicle is not subject to impound, the request <br /> 9 shall be treated as a non-preference matter and the request shall be referred to a <br /> 10 qualified "Class A" licensee in the same manner as if the police were requesting the <br /> 11 towing service pursuant to an impound. <br /> 12 3. All referrals under Subsection 2 shall be distributed on a rotation basis <br /> 13 among qualified "Class A" licensees who have notified the Police Department in writing <br /> 14 of their willingness to accept such referrals. If deemed necessary by the Chief of <br /> 15 Police, zones may be set up with such referrals from rotation lists within each zone; <br /> 16 provided, however, nothing herein shall be construed as requiring such zones. <br /> 17 4. Except in regard to impounds, nothing herein shall be construed to <br /> 18 preclude any person from requesting the services of a licensed towing business of their <br /> 19 choice, unless in the opinion of the Police Department, accommodating such request <br /> 20 would result in undue delay or the maintenance of a hazardous situation or condition. <br /> 21 5. Any licensee desiring to participate in police requested towing services <br /> 22 and impounds shall make a written request of the Chief of Police to be placed on the <br /> 23 list of "Class A" licensees. Upon receipt of such a written request, the Chief of Police <br /> 24 shall direct that an inspection of the requesting licensee's equipment, business location, <br /> 25 operation and personnel take place. If the requesting licensee meets the requirements <br /> 26 of this ordinance for "Class A" licensees, such licensee shall be added to the bottom of <br /> 27 the list of qualified "Class A" licensees. The Chief of Police shall provide each such <br /> 28 licensee with a current list of the maximum fees to be charged for towing services <br /> 29 requested by the Everett Police Department or its dispatcher. <br /> 30 <br /> 31 <br /> 32 Page -6- <br />
