If such entry is refused, the Building Official 2 or his authorized representative shall have recourse to every remedy provided by law to secure entry. 3 "Authorized Representative" shall include the officers named in Section 4 202 (a) and (b) of this Code. 5 No owner or occupant or any other person having charge, care or control of any building or premises shall fail or neglect, after proper demand is 6 made as herein provided, to promptly permit entry therein by the Building Official or his authorized representative for the purpose of inspection and 7 examination pursuant to this Code. Any person violating this Subsection shall be guilty of a misdemeanor. 8 and inserting in its place: 9 Whenever necessary to make an inspection to enforce any provision of this 10 ordinance, the Building Official or his authorized representative may enter any building or premises as prescribed in Ordinance 315-74. 11 Section 11. That Section 204 of the Uniform Building Code be, and is hereby 12 amended by deleting: 13 In order to determine the suitability of alternate materials and methods of 14 construction and to provide for reasonable interpretations of the provi- sions of this Code, there shall be and is hereby created a Board of 15 Appeals, consisting of five members who are qualified by experience and training to pass upon matters pertaining to building construction. The 16 Building Official shall be an ex officio member and shall act as Secretary of the Board. The Board of Appeals shall be appointed by the Governing 17 Body and shall hold office at its pleasure.
