. r ' <br /> i / <br /> 1 the owner or other persons having charge or control of the building or <br /> premises and demand entry. If such entry is refused, the Building Official <br /> 2 or his authorized representative shall have recourse to every remedy <br /> provided by law to secure entry. <br /> 3 <br /> "Authorized Representative" shall include the officers named in Section <br /> 4 202 (a) and (b) of this Code. <br /> 5 No owner or occupant or any other person having charge, care or control <br /> of any building or premises shall fail or neglect, after proper demand is <br /> 6 made as herein provided, to promptly permit entry therein by the Building <br /> Official or his authorized representative for the purpose of inspection and <br /> 7 examination pursuant to this Code. Any person violating this Subsection <br /> shall be guilty of a misdemeanor. <br /> 8 <br /> and inserting in its place: <br /> 9 <br /> Whenever necessary to make an inspection to enforce any provision of this <br /> 10 ordinance, the Building Official or his authorized representative may <br /> enter any building or premises as prescribed in Ordinance 315-74. <br /> 11 <br /> Section 11. That Section 204 of the Uniform Building Code be, and is hereby <br /> 12 <br /> amended by deleting: <br /> 13 <br /> In order to determine the suitability of alternate materials and methods of <br /> 14 construction and to provide for reasonable interpretations of the provi- <br /> sions of this Code, there shall be and is hereby created a Board of <br /> 15 Appeals, consisting of five members who are qualified by experience and <br /> training to pass upon matters pertaining to building construction. The <br /> 16 Building Official shall be an ex officio member and shall act as Secretary <br /> of the Board. The Board of Appeals shall be appointed by the Governing <br /> 17 Body and shall hold office at its pleasure. The Board shall adopt <br /> reasonable rules and regulations for conducting its investigations and shall <br /> 18 render all decisions and findings in writing to the Building Official with a <br /> duplicate copy to the appellant and may recommend to the Governing <br /> 19 Body such new legislation as is consistent therewith. <br /> 20 and inserting in its place: <br /> 21 In order to determine the suitability of alternate materials and methods of <br /> construction and to provide for reasonable interpretation of the provisions <br /> 22 of this Code, there shall be and is hereby a Board of Appeals, as created <br /> by Ordinance No. 351-75, Chapter 1.12 EMC, to pass upon matters <br /> 23 pertaining to building construction. <br /> 24 Section 12. That Section 301 (a) of the Uniform Building Code be, and is hereby <br /> 25 amended by deleting: <br /> 26 No person, firm, or corporation shall erect, construct, enlarge, alter, <br /> repair, move, improve, remove, convert, or demolish any building or <br /> 27 structure in the city, or cause the same to be done, without first obtaining <br /> a separate building permit for each such building or structure from the <br /> 28 Building Official. <br /> 29 and inserting in its place: <br /> 30 No person, firm, or corporation shall erect, construct, enlarge, alter, <br /> repair, move, improve, remove, convert, or demolish any building or <br /> 31 structure in the city, or cause the same to be done, without first obtaining <br /> 32 <br /> - 3 - <br />
