1 provided that if such building or premises be occupied, he shall first <br /> present proper credentials and demand entry; and if such building or <br /> 2 premises be unoccupied he shall first make a reasonable effort to locate <br /> the owner or other persons having charge or control of the building or <br /> 3 premises and demand entry. If such entry is refused, the Building Official <br /> or his authorized representative shall have recourse to every remedy <br /> 4 provided by law to secure entry. <br /> 5 "Authorized Representative" shall include the officers named in Section <br /> 201 (a) and (b) of this Code. <br /> 6 <br /> No owner or occupancy or any other person having charge, care or control <br /> 7 of any building or premises shall fail or neglect, after proper demand is <br /> made as herein provided, to promptly permit entry therein by the Building <br /> 8 Official or his authorized representative for the purpose of inspection and <br /> examination pursuant to this Code. Any person violating this subsection <br /> 9 shall be guilty of a misdemeanor. <br /> 10 and inserting in its place: <br /> 11 Whenever necessary to make an inspection to enforce any provision of this <br /> Code, the Building Official or his authorized representative may enter any <br /> 12 building or premises as prescribed in Ordinance 315-74, Chapter 1.12 <br /> EMC. <br /> 13 <br /> Section 22. That Section 303 (b) of the Uniform Mechanical Code be, and is <br /> 14 <br /> hereby amended by deleting: <br /> 15 <br /> SEC. 302 (b) EXPIRATION. Every permit issued by the Building <br /> 16 Official under the provisions of this Code shall expire by limitation <br /> and become null and void, if the building or work authorized by such <br /> 17 permit is not commenced within 60 days from the date of such <br /> permit, or if the building or work authorized by such permit is <br /> 18 suspended or abandoned at any time after the work is commenced for <br /> a period of 120 days. Before such work can be recommenced a new <br /> 19 permit shall be obtained first so to do, and the fee therefore shall be <br /> one-half the amount required for a new permit for such work, <br /> 20 provided no changes have been made or will be made in the original <br /> plans and specifications for such work; and provided, further, that <br /> 21 such suspension or abandonment has not exceeded one year. <br /> 22 and inserting in its place: <br /> 23 SEC. 302 (d) EXPIRATION. Permits and renewed permits shall <br /> expire one (1) year from date of issue except as otherwise specified. <br /> 24 Where conditions require, the Building Official may, as he deems <br /> necessary, issue non-renewable permits which shall expire within a <br /> 25 period less than one (1) year from date or issue. Permits may be <br /> renewed and renewed permits may be further renewed by the Building <br /> 26 Official upon application within the thirty (30) day period immedi- <br /> ately preceding the date of expiration thereof, provided that the work <br /> 27 permitted has been started and is progressing at a rate approved by <br /> the Building Official. Permits may also be renewed where corn- <br /> 28 mencement or completion of the work is delayed by litigation, <br /> appeals, strikes or other causes beyond the permittee's control. <br /> 29 Progress justifying renewal of a permit where the work has been <br /> started, shall include but not be limited to the arranging of financing, <br /> 30 preparation of environmental assessments, preparation of plans and <br /> specification, selection of contractors and subcontractors, securing <br /> 31 other necessary premits and licenses, site preparation such as <br /> demolition, clearing and excavation, soils investigation, and work <br /> 32 done to overcome unusual construction difficulties. <br /> - 9 - <br />
