1 provided that if such building or premises be occupied, he shall first present proper credentials and demand entry; and if such building or 2 premises be unoccupied he shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or 3 premises and demand entry. If such entry is refused, the Building Official or his authorized representative shall have recourse to every remedy 4 provided by law to secure entry. 5 "Authorized Representative" shall include the officers named in Section 201 (a) and (b) of this Code. 6 No owner or occupancy or any other person having charge, care or control 7 of any building or premises shall fail or neglect, after proper demand is made as herein provided, to promptly permit entry therein by the Building 8 Official or his authorized representative for the purpose of inspection and examination pursuant to this Code. Any person violating this subsection 9 shall be guilty of a misdemeanor. 10 and inserting in its place: 11 Whenever necessary to make an inspection to enforce any provision of this Code, the Building Official or his authorized representative may enter any 12 building or premises as prescribed in Ordinance 315-74, Chapter 1.12 EMC. 13 Section 22. That Section 303 (b) of the Uniform Mechanical Code be, and is 14 hereby amended by deleting: 15 SEC. 302 (b) EXPIRATION. Every permit issued by the Building 16 Official under the provisions of this Code shall expire by limitation and become null and void, if the building or work authorized by such 17 permit is not commenced within 60 days from the date of such permit, or if the building or work authorized by such permit is 18 suspended or abandoned at any time after the work is commenced for a period of 120 days. Before such work can be recommenced a new 19 permit shall be obtained first so to do, and the fee therefore shall be one-half the amount required for a new permit for such work, 20 provided no changes have been made or will be made in the original plans and specifications for such work; and provided, further, that 21 such suspension or abandonment has not exceeded one year. 22 and inserting in its place: 23 SEC. 302 (d) EXPIRATION. Permits and renewed permits shall expire one (1) year from date of issue except as otherwise specified. 24 Where conditions require, the Building Official may, as he deems necessary, issue non-renewable permits which shall expire within a 25 period less than one (1) year from date or issue. Permits may be renewed and renewed permits may be further renewed by the Building 26 Official upon application within the thirty (30) day period immedi- ately preceding the date of expiration thereof, provided that the work 27 permitted has been started and is progressing at a rate approved by the Building Official. Permits may also be renewed where corn- 28 mencement or completion of the work is delayed by litigation, appeals, strikes or other causes beyond the permittee's control. 29 Progress justifying renewal of a permit where the work has been started, shall include but not be limited to the arranging of financing, 30 preparation of environmental assessments, preparation of plans and specification, selection of contractors and subcontractors, securing 31 other necessary premits and licenses, site preparation such as demolition, clearing and excavation, soils investigation, and work 32 done to overcome unusual construction difficulties. - 9 -
