• <br /> Section 4: MAINTENANCE. All electric wires, equipment and apparatus <br /> shall be maintained in a safe condition. All devices and safeguards which <br /> are required by this code in a building, sign or structure when erected, <br /> altered or repaired shall be maintained in a safe and good working order. <br /> The owner or his agent shall be responsible for the maintenance of all <br /> such electrical wiring, equipment and apparatus. <br /> Section 5: MOVED BUILDINGS. All electrical wires, equipment, or <br /> apparatus within, or on, or attached thereto, which are moved within or <br /> into the City shall comply with the provisions of this Ordinance and all <br /> other applicable laws, codes and ordinances. <br /> Section 6: ADMINISTRATIVE AUTHORITY & ASSISTANTS. The Building <br /> Official is hereby authorized and directed to enforce all the provisions <br /> of this ordinance. For such purpose he shall have the powers of a <br /> police officer. In accordance with procedure and with the approval of <br /> the chief appointing authority of the City, the Building Official <br /> may appoint such number of officers, inspectors, and assistants and <br /> other employees as may be necessary to carry out the functions of this <br /> ordinance. <br /> Section 7: REPORTS AND RECORDS. The Building Official shall submit <br /> a report to the proper City official not less than once a year, covering <br /> the work of the department during the preceding period. He shall <br /> incorporate in said report a summary of his recommendations as to desirable <br /> amendments to this Code. <br /> The Building Official shall keep a permanent, accurate account of <br /> all fees and other monies collected and received under this Code, the <br /> names of the persons upon whose account the same were paid, the date <br /> and amount thereof, together with the location of the building or <br /> premises to which they relate. <br /> Section 8: RIGHT OF ENTRY. Whenever necessary to make an <br /> inspection to enforce any provision of this ordinance, the Building <br /> Official or his authorized representative may enter any building or <br /> premises as prescribed in Ordinance 315-74. <br /> Section 9: STOP ORDERS. Whenever any work is being done contrary <br /> to the provisions of this Ordinance, the Building Official may order <br /> the work stopped by notice in writing served on any persons engaged <br /> in the doing or causing such work to be done and any such persons shall <br /> forthwith stop such work until authorized by the Building Official to <br /> proceed with the work. <br /> Section 10: LIABILITY. The Building Official or any employee <br /> charged with the enforcement of this Ordinance, acting in good faith <br /> and without malice for the City in the discharge of his duties, shall <br /> not thereby render himself liable personally and he is hereby relieved <br /> from all personal liability for any damage that may accrue to persons <br /> or property as a result of any act required or by reason of any act or <br /> omission in the discharge of his duties. Any suit brought against the <br /> Building Official or employee, because of such act or omission performed by <br /> him in the enforcement of any provisions of this Code, shall be defended by <br /> the legal department of the city until final termination of the proceedings. <br /> This Ordinance is one of general application and nothing herein is intended <br /> to create liability or cause action running in favor of individual members <br /> of the public. <br /> ' Section 11: UNSAFE CONDITIONS. All electrical wires, equipment <br /> and apparatus which are unsafe or not provided with adequate safeguards, <br /> or which constitute a fire hazard, or are otherwise dangerous to human <br /> life, or which in relation to existing use constitute a hazard to <br /> safety or health, or public welfare, by reason of inadequate maintenance, <br /> obsolescense, fire hazard, disaster damage, or abandonment, as specified <br /> in this Ordinance or any other effective ordinance, are, for the purpose <br /> of this Section, considered unsafe conditions. All such unsafe <br /> conditions are hereby declared to be public nuisances and the owner or <br /> his agent must abate by repair, rehabilitation, demolition, or removal <br /> in accordance with this Ordinance or by any other procedures provided by law. <br /> -2- <br />
