I <br /> 4. Bidder shall meet all Supplemental Bidder Responsibility Criteria(RCW 39.04.350(2))as noted in I <br /> Document 00 22 13 -Supplemental Instructions To Bidders. <br /> a. If there is no Document 00 22 13 - Supplemental Instructions To Bidders in the bid <br /> package,then the Project is not subject to supplemental bidder responsibility criteria. <br /> B. The City, in its sole discretion, reserves the right to accept or reject any and all bids submitted and to <br /> waive informalities and minor irregularities. <br /> 1.22 BID PROTESTS I <br /> A. All protests by Bidders must be in accordance with Everett Municipal Code 3.46, "Bid Protest <br /> Procedures." i <br /> 1.23 PRE-AWARD CONFERENCE <br /> A. After Bid opening, but prior to award, the apparent successful Bidder shall, if requested by the City, I <br /> attend a pre-award conference to respond to questions by the City regarding evaluation of Bids. <br /> 1. The City will emphasize items such as insurance and bonding that will assist in prompt issuance of <br /> the Notice to proceed. <br /> 2. By conducting a pre-award conference, the City has not thereby waived its right to make <br /> determinations regarding responsiveness and responsibility of the Bidder. <br /> 1.24 ACCEPTANCE OF BID <br /> I <br /> A. Within 45 days after the opening of Bids, the City will act either to accept the Bid from the lowest <br /> responsive,responsible Bidder, or to reject all Bids. <br /> 1. The City reserves the right to request extensions of such Bid acceptance period. <br /> B. After acceptance by Owner, City's Project Manager, on behalf of Owner, will issue to the accepted I <br /> Bidder a written Notice of Award of Contract. <br /> 1. Notice of Award of Contract will be delivered in person or by certified mail to the Bidder whose <br /> Bid is accepted. <br /> 2. Notice of Award of Contract will also include a request to furnish a performance and payment <br /> bond and evidence of insurance and to execute the Contract set forth in the Contract Documents. <br /> C. Notwithstanding delay in the preparation and execution of the Contract, accepted Bidder shall be <br /> prepared, upon written Notice to Proceed, to commence Work within 30 calendar days following receipt <br /> III <br /> of official written order of Owner to proceed,or on date stipulated in such order. <br /> D. Bidder has 14 calendar days after receiving the Notice of Award to submit the following documents to the <br /> City: <br /> 1. Two executed copies of the Contract. <br /> 2.
