I <br /> 11 <br /> 2 Vacant <br /> I4 <br /> 35 <br /> I6 <br /> 7 1-09.11(3) Time Limitation and Jurisdiction <br /> 8 (July 23, 2015 APWA GSP) <br /> I9 <br /> 10 Revise this section to read: <br /> 11 <br /> 12 For the convenience of the parties to the Contract it is mutually agreed by the parties that any <br /> I13 claims or causes of action which the Contractor has against the Contracting Agency arising <br /> 14 from the Contract shall be brought within 180 calendar days from the date of final acceptance <br /> 15 (Section 1-05.12) of the Contract by the Contracting Agency; and it is further agreed that any <br /> I16 such claims or causes of action shall be brought only in the Superior Court of the county <br /> 17 where the Contracting Agency headquarters is located, provided that where an action is <br /> 18 asserted against a county, RCW 36.01.05 shall control venue and jurisdiction. The parties <br /> I19 understand and agree that the Contractor's failure to bring suit within the time period provided, <br /> 20 shall be a complete bar to any such claims or causes of action. It is further mutually agreed <br /> 21 by the parties that when any claims or causes of action which the Contractor asserts against <br /> 22 the Contracting Agency arising from the Contract are filed with the Contracting Agency or <br /> 23 initiated in court, the Contractor shall permit the Contracting Agency to have timely access to <br /> 24 any records deemed necessary by the Contracting Agency to assist in evaluating the claims <br /> I25 or action. <br /> 26 <br /> 27 <br /> 28 1-10 TEMPORARY TRAFFIC CONTROL <br /> 1 29 <br /> 30 <br /> 31 1-10.2 Traffic Control Management <br /> 1 32 Section 1-10.2 is supplemented with the following: <br /> 33 <br /> 34 <br /> I35 A Temporary Traffic Control (TTC) plan for closure of three lanes along West Marine View <br /> 36 Drive (WMVD) is provided in the contract plans. It is expected that this lane closure <br /> 37 configuration may exist for much of the pipe installation along WMVD. The provided TTC <br /> 1 38 plans along WMVD may require some modifications based on information provided in these <br /> 39 provisions, and requests from the Port of Everett due to on-going construction projects in the <br /> 40 Port, or changes in the Port's access needs. All TTC plans to be implemented during <br /> I41 construction, including schedules and durations of the TTC, must be submitted to the <br /> 42 engineer for final approval prior to implementation, including use of the plans provided in the <br /> 43 contract documents. <br /> I44 <br /> 45 The Contracting Agency's anticipated project specific Standard Temporary Traffic Control <br /> 46 plans are provided as guidelines in Appendix A of these Special Provisions. Final TTC plans <br /> 47 submitted for approval must account for impacts to vehicle and pedestrian access through <br /> I48 and around the construction zones on West Marine View Drive, including maintenance of <br /> 49 ADA access along the west side of WMVD.
