1 <br /> 1 resurveying, checking, correction of errors, replacement of missing or damaged stakes, and <br /> 2 coordination efforts. <br /> 3 <br /> 4 1-05.7 Removal of Defective and Unauthorized Work <br /> 5 (October 1, 2005 APWA GSP) <br /> 6 <br /> 7 Supplement this section with the following: <br /> 8 <br /> 9 If the Contractor fails to remedy defective or unauthorized work within the time specified in a <br /> 10 written notice from the Engineer, or fails to perform any part of the work required by the <br /> 11 Contract Documents, the Engineer may correct and remedy such work as may be identified <br /> 12 in the written notice, with Contracting Agency forces or by such other means as the <br /> 13 Contracting Agency may deem necessary. <br /> 14 <br /> 15 If the Contractor fails to comply with a written order to remedy what the Engineer determines <br /> 16 to be an emergency situation, the Engineer may have the defective and unauthorized work <br /> 17 corrected immediately, have the rejected work removed and replaced, or have work the <br /> 18 Contractor refuses to perform completed by using Contracting Agency or other forces. An <br /> 19 emergency situation is any situation when, in the opinion of the Engineer, a delay in its <br /> 20 remedy could be potentially unsafe, or might cause serious risk of loss or damage to the <br /> 21 public. <br /> 22 <br /> 23 Direct or indirect costs incurred by the Contracting Agency attributable to correcting and <br /> 24 remedying defective or unauthorized work, or work the Contractor failed or refused to <br /> 25 perform, shall be paid by the Contractor. Payment will be deducted by the Engineer from <br /> 26 monies due, or to become due, the Contractor. Such direct and indirect costs shall include in <br /> 27 parrCicuiar, but without limitation, compensation for additional professional services required, <br /> 28 and costs for repair and replacement of work of others destroyed or damaged by correction, <br /> 29 removal, or replacement of the Contractor's unauthorized work. 111 <br /> 30 <br /> 31 No adjustment in contract time or compensation will be allowed because of the delay in the <br /> 32 performance of the work attributable to the exercise of the Contracting Agency's rights I <br /> 33 provided by this Section. <br /> 34 <br /> 35 The rights exercised under the provisions of this section shall not diminish the Contracting <br /> 36 Agency's right to pursue any other avenue for additional remedy or damages with respect to <br /> 37 the Contractor's failure to perform the work as required. <br /> 38 <br /> 39 <br /> 40 1-05.11 Final Inspection <br /> 41 <br /> 42 Delete this section and replace it with the following: <br /> 43 <br /> 44 1-05.11 Final Inspections and Operational Testing <br /> 45 (October 1, 2005 APWA GSP) <br /> 46 <br /> 47 1-05.11(1) Substantial Completion Date <br /> 48 I 49 When the Contractor considers the work to be substantially complete, the Contractor shall <br /> 50 so notify the Engineer and request the Engineer establish the Substantial Completion Date. <br /> WEST MARINE VIEW DRIVE UTILITIES PAGE 25 OF 117 August 2018 ' <br /> WORK ORDER#3588 <br /> SPECIAL PROVISIONS <br />
