I 1 1 The Contractor's request shall list the specific items of work that remain to be completed in 2 order to reach physical completion. The Engineer will schedule an inspection of the work I 3 4 with the Contractor to determine the status of completion. The Engineer may also establish the Substantial Completion Date unilaterally. 5 I 6 7 If, after this inspection, the Engineer concurs with the Contractor that the work is substantially complete and ready for its intended use, the Engineer, by written notice to the 8 Contractor, will set the Substantial Completion Date. If, after this inspection the Engineer 9 does not consider the work substantially complete and ready for its intended use, the I10 Engineer will, by written notice, so notify the Contractor giving the reasons therefor. 11 12 Upon receipt of written notice concurring in or denying substantial completion, whichever is I13 applicable, the Contractor shall pursue vigorously, diligently and without unauthorized 14 interruption, the work necessary to reach Substantial and Physical Completion. The 15 Contractor shall provide the Engineer with a revised schedule indicating when the I16 Contractor expects to reach substantial and physical completion of the work. 17 18 The above process shall be repeated until the Engineer establishes the Substantial I19 Completion Date and the Contractor considers the work physically complete and ready for 20 final inspection. 21 I22 1-05.11(2) Final Inspection and Physical Completion Date 23 24 When the Contractor considers the work physically complete and ready for final inspection, ' 25 the Contractor by written notice, shall request the Engineer to schedule a final inspection. 26 The Engineer will seta date for final inspection. The Contractor I29 shall immediately take such corrective measures as are necessary to remedy the listed 30 deficiencies. Corrective work shall be pursued vigorously, diligently, and without interruption 31 until physical completion of the listed deficiencies. This process will continue until the I32 Engineer is satisfied the listed deficiencies have been corrected. 33 34 If action to correct the listed deficiencies is not initiated within 7 days after receipt of the I35 written notice listing the deficiencies, the Engineer may, upon written notice to the 36 Contractor, take whatever steps are necessary to correct those deficiencies pursuant to 37 Section 1-05.7. I38 The Contractor will not be allowed an extension of contract time because of a delay in the 39 performance of the work attributable to the exercise of the Engineer's right hereunder. 40 I41 Upon correction of all deficiencies, the Engineer will notify the Contractor and the Contracting 42 Agency, in writing, of the date upon which the work was considered physically complete. That 43 date shall constitute the Physical Completion Date of the contract, but shall not imply 44 acceptance of the work or that all the obligations of the Contractor under the contract have I45 been fulfilled. 46 47 1-05.11(3) Operational Testing I48 49 It is the intent of the Contracting Agency to have at the Physical Completion Date a 50 complete and operable system.
