Subs��quent to the hearing, as ordered by the Hearing Examiner, the following exhibit <br />was subm�tted and admitted as part of the official record of these proceedings: <br />9. Memo from Becky Fauver, Planning Department, dated April 21, 2005, regarding <br />SEPA exemption <br />All of the exhibits are availabie for inspecti�n at the Hearing Examiner's Office located at <br />2930 Wetmore Avenue, 8th floor, Evsrett, Washington. <br />After due consideration of the testimony and evidence presented by the Appiicant and <br />testimony and evidence elicited durin� the public hearing, the following Findings of Fact <br />and Conclusions constitute the basis of the decision of the Everett Hearing Examiner. <br />FINDINGS OF FACT <br />The Applicant requested approval of a Special Property Use Permit for the <br />installation of three eight-foot high panel antennas to be flush mounted to an <br />existing communication tower/flag pole on property located at 220 Olympic <br />Boulevard, Everett, Washington (subject property). The proposal also includes <br />an equipment cabinet that would have dimensions of 7 feet x 17 feet. (exhibit 1, <br />Fauver testimony) <br />2. The subject property is zoned B-2, Community Business and has a General <br />Comprehensive Plan designation of 4.1, Neighborhood Business. The existing <br />land use of the subject property is a shopping center. (exhibit 1) <br />3. The property to the north is Multiple-Family Residential/R-3; the property to the <br />south is CommerciallB-2; the property to the east is a church and zoned R-1; and <br />the property to the west is Single-Family Residential/R-2. (exhibit 1) <br />On May 19, 2000, the Hearing Examiner of the City of Everett approved a <br />Special Property Use Permit for a 75-foot high self-supporting flagpole/tower on- <br />site. The flag pole/cell tower was completed, and at the time, the antennas for <br />the cellular service were located in the tower/flag pole shucture. Because of the <br />design of the pole/tower and the intent of the Applicant to coilocate on-site, <br />antennas must be constructed that are flush mounted to the tower. No new <br />tower would be built. (exhibit 1, Fauver testimony) <br />5. In order for a Special Property Use Permit to be granted within the City of <br />Everett, the criteria of Everett Municipal Code (EMC) 19.41.150.0 must be <br />satisfied. A summary of these criteria is: <br />(1) The need of the neighborhood, district, or City for a proposed Special <br />Property Use. <br />
